Former CIA officer sues Cheney, Libby, Rove over leak
Plame alleges Bush administration officials ruined her career

    Thursday, July 13, 2006; Posted: 3:41 p.m. EDT (19:41 GMT)

WASHINGTON (AP) -- The CIA officer whose identity was leaked to reporters sued Vice President Dick Cheney, his former top aide and presidential adviser Karl Rove on Thursday, accusing them and other White House officials of conspiring to destroy her career.

In a lawsuit filed in U.S. District Court, Valerie Plame and her husband, Joseph Wilson, a former U.S. ambassador, accused Cheney, Rove and I. Lewis "Scooter" Libby of revealing Plame's CIA identity in seeking revenge against Wilson for criticizing the Bush administration's motives in Iraq.

Several news organizations wrote about Plame after syndicated columnist Robert Novak named her in a column on July 14, 2003. Novak's column appeared eight days after Wilson alleged in an opinion piece in The New York Times that the administration had twisted prewar intelligence on Iraq to justify going to war.

The CIA had sent Wilson to Niger in early 2002 to determine whether there was any truth to reports that Saddam Hussein's government had tried to buy yellowcake uranium from Niger to make a nuclear weapon. Wilson discounted the reports, but the allegation nevertheless wound up in President Bush's 2003 State of the Union address.

I haven't followed this story a lot recently but didn't the original reporter claim to have found her name in a Who's Who book of Washington?

So, telling the truth ruined her career?

Yes, when someone tells the world that an undercover CIA operative works for the CIA, it tends to ruin their career.

Her name was there as Wilson's wife, but it did not say who she worked for.

A scan of the Who's Who passage in question is in the "Was Karl Rove the source of the Plame leak..." thread.

I say this is just for attention at this point. If Fitzgerald couldn't get anything, neither will Plame.

Fitz got an indictment and has a pending criminal trial, not to mention that the legal issues in each case are different.

...which is why they're bringing a civil case and not a "criminal" one. Get it?

    Burden of proof is different.

    [rquoter]
STANDARD OF PROOF - CRIMINAL CASES

The criminal standard of proof on the prosecution is proof beyond all reasonable doubt, which means proof to a high degree of probability but not proof beyond a shadow of a doubt. (Miller v Minister of Pensions).

The criminal standard of proof on a defendant is the same as the civil standard, i.e., proof on the balance of probabilities.

STANDARD OF PROOF - CIVIL CASES

The standard of proof on both parties is proof on the balance of probabilities, i.e., that an allegation is more probable than not.

Doubtful. If it even gets there the defense will no doubt have it as narrow as humanly possible on both sides with a great wall of china protective order.

But I wouldn't doubt if discovery is used as a cover for the prototypical right wing hate mailing "Bill runs drugs out of the oval office!" "Richard Clarke is a closet ***!" "McCain has a black baby!"....etc.

....and I think you have no idea how defense counsel operates in civil cases and how they protect their clients interest and closing things down as quickly and painlessly as possible rather than to give proud Baskeball BBS republicans something to chat about.

Not just the burden of proof but the entire inquiry.

Fitzgerald investigated various criminal laws relating to disclosure of information.

Plame/Wilson are filing a civil case based on constitutional claims.

I know you're trying to be funny, but I will note for the record that her standing has increased dramatically. Colbert even mentioned her at the Press thingy a few weeks back. I'm sure she is now one of the most sought after invites on the cocktail circuit where before, she and Joe would have been 3rd rate at best and never mentioned on TV. The lawsuit gives the imression that she puts more value in the service to her country and not so much in her party schedule.
