I tend to agree. It's a sure bet that smart business people will "smart" from this trial and look for more innovative ways to elude the judicial scrutiny.

I'll be surprised if either gets a presidential pardon from Bush. People here are way too jaded. Of course, if they do get a pardon, that'll probably make me as jaded as everyone else.
I don't think it's possible to find more 'innovative' ways to do it than some of the vehicles Enron used. And no, no one will get a pardon. No way.
I'm not so sure, I think business journalists (esp. Fortune & WSJ) & equity analysts feel the same way now that political writers and special prosecutors felt after Watergate, either very empowered for scooping or embarrassed for getting scooped; either way they'll be more probing and aggressive now than before. By the way, should the defense have focused more on David Duncan rather than Fastow or the run on the bank theory, even though Andersen itself was ultimately acquitted, and Duncan (as I just found out from wikipedia) withdrew his guilty plea? Any informed predicitions about the appeals?
I agree with you it'd be extremely foolish and unpopular for Bush to pardon one of these two. On the other hand, I'd be surprised if this case doesn't go all the way to the SCOTUS. The high court justices have nothing to lose, nothing to fear. Can one be so confident that none of these justices would look into the 'technicalities' of this trial and expound on any of the 'abnormalities'? Already someone wrote on Forbes.com: You never know who will get the last laugh -- as someone put it, "Alitowned."

From everything I have read this is going to be tough to appeal. Judge lake is a pretty well regarded Judge and the district it is in probably won't overule without something major. they can spend as much as they want on appealing but I think it will just delay the inevitable. (does Lay even have much of a defense fund left?, I know Skilling does). Either way they are screwed... Plus bring on the Civil cases...ouch
Who was the millionaire whom everyone expected Clinton to pardon at the end? The guy who fled the country and is living in Switzerland? If I were the Enron guys, I would get in touch with him...forget going to prison, take your money and run. DD
