It isn't the predominant viewpoint, so it isn't a social norm. Handshakes are a social norm. It's like saying since teammates pat each other on the butt after a good job, you could do the same with your female co-workers. From what I understand, what you mean by "liberalism" involve what's allowed and what isn't between the involved parties? For example, some people like S&M, but with the wrong crowd, that's torture and illegal. A "liberal" viewpoint would claim since they both wanted it, they're within their right to do it. That's what I get, anyways...
Note that I didn't call it the liberal viewpoint. That's the label given to it by philosophers. I stated this a couple of times. What I was getting at was why isn't rape treated as a simple assault if there's nothing special about the act itself?
What's funny is that most "liberals" I know actually have intercourse at the beginning of the workday just to say hello, while most "conservatives" chat at the coffee machine instead. Again, just going by what philosophers say.
That's what I was getting at with the quotes. Isn't that viewpoint you described determined by choice? When a law is broken, intent is strongly weighed in the judgement and sentence.... There's obviously something special about sex if more than enough people get all fussed up over it. More often than not, laws in a free society are based on cultural norms....
You guys should read Scoop Jackson's article on this Duke deal, it's not exactly on the subject of this thread, but still a good read. Apparently, Duke's lacrosse team is half full of trouble makers, but the university kept it a secret because they have influential parents or something.
