i can't pretend to speak for all neoprogressives, but she was clearly itellectually inadequet. no shame in that, i imagine most lawyers are, and she had the grace to realize it and withdraw. i don't particularly care about her positions- my hope is W picks someone in the scalia/roberts mode in terms of brain power. JRB would be ideal.
It was fun watching right wingers and the exreme right wingers fight. As far as the Scalia (competent right winger) vs Thomas (incompetent-follower right winger) distinction, it is relatively unimortant. It is the votes that count. Legal realism: The legal theory that says what is "Constitutional" is whatever the current S.Ct. says is "Constitutional". Always good to inject some reality into this type of discussion.

"Strict constructionist" is another buzz word previously employed part of the Right's well funded attempt to pretend that only liberals make decisions that aren't according to precedent or some alleged intent of the long dead "framers" I wonder whether it might just be better to be more forthright that the judges often vote according to their religious, moral and political values, which often have little to do with Court precedent.
Even if they could have reassured every pro-life person in back room, non-public meetings I'm not sure that would have been enough for the far right. I think a. they wanted someone with a voting record supporting that. b. they want a fight on a national public stage. They want to have a far right candidate who is hated by the Democrats so they can ram that person down the Democrats throats. Roberts is too qualified, and there are some questions about if he is "far right enough" to have that fight. The far right has been waiting for this (this being a republican president with a republican senate) so they can have public fight. They want Blood.
They want Blood. Why pick a fight that you can not win? The Democrats will filibuster anyone that the social conservatives want for this nomination.

I hate the fact that alotof right wingers are openly trying to push a more conservative judge to the supreme court..since when did our legal system become a system of bias and agenda.
