[help] quick INS question (i-131 travel)

    what are the requirements to file a i-131? background being canadian that came to america and got married but hasn't yet filed any paperwork for adjustment of status. can they fill out just the i-131 and submit it to be able to travel to/from canada without any trouble? or do they need to file other papers with it as well?

    Did you try to GOOGLE it or look for it yourself already?

    Good news. You can e-file for this (fill it out and pay for it online):
    http://uscis.gov/graphics/formsfee/forms/e-i-131.htm
    There is a place there that asks (paraphrasing): "What is your status?"
    You'd put on there that you've applied or are waiting for response for your I-485 through your wife (hoping you're a male).

    thanks a ton! i did look in google but it was hard to find the specific requirements. i guess i'm confused about whether the marriage makes her a conditional permanent resident, or if the i-485 already has to be pending.

    and yes im male :)

    Conditional, yes. the I-485 could be pending, and in the mean time she can also get a Work Authorization if she and you are interested. Also, get all the documents, photos, receipts, etc., showing how long she's been here legally, because they will ask for EVERYTHING to prove so.

    If it is for your spouse, once she married you in court she's with you here as long as you want her to stay here. You claim her now as being with you, so it's a done deal. Don't quote me, but it could be less than 6 months for her to get a response. You may not need the work permit after all. She COULD get a non-for-work SSN if you need as well, but then will have to go and change the "not authorized to work" note on it later and it might be a hassle.
