Are you still using Napster?

    It depends on who owns the copyrights. Remember that the US Copyright Act didn't exist until 1972, long after Coltrane died. Much of the music before that was in dispute as to whether it was considered "public domian" or "intellectual property."

    In addition, much of what Coltrane performed (if not all) were covers of standards.

    Coltrane is probably a bad example of how copyright law works and who benefits because his recordings did not fall under the scope of the copyright laws that came after him.

    True. I couldn't remember when the copyright act went into place, so I wasn't sure.

    I'd like to see proof that artists' profits have been harmed since the creation of Napster.

    You want proof? Here's your proof:

    LimeWire aka "Gnutella" seems to work pretty well. I hear good things about I-mesh also. I never plan on paying for a CD again in my life....Screw Dre, Metallica, and the music industry.

    Here's a verified instance of Napster & Napster-like services resulting in someone acquiring the music product illegally and resulting in fewer sales for the artist.

    Are there benefits to Napster as well (through sampling, etc)? Absolutely. Are the benefits greater than the harm? Who knows. However, if anything, it's up to Napster to prove their their intellectual property theft results in more benefits. We don't just make intellectual property theft legal because there MIGHT be some"benefit to it. Besides, it's not YOUR choice over how SOMEONE ELSE'S intellectual property is used.
    The point is, it's their property. If they want you to sample it, they'll let you. If you don't like their policies, don't buy their product. Some other company can't just come up and start doing whatever the hell they want with your intellectual property just because they want to.

    The industry should simply concentrate on preventing people from being able to transfer MP3s to CDs. That way music could still be downloaded, but for listening purposes only. Not for pirating. If people wanted to listen to music without using their computer, they would have to buy the CD.

    I bought that Saliva CD the next day. I haven't seen any cops knocking on my door yet, either.

    I use the Nappy much less nowadays for the simply fact that our honeymoon is over. I really got into it in the beggining, and love the idea just as much but damn I gotta get away from my computer and get outside and do something.
    Anyhow, I just saw this article in CNN about a program called SONGBIRD that keeps track of music artists stuff and tells them where and who and whats hapening with it...uh like what Napster is doing with their music.
    I'd love for Lars to find out I downloaded one of his songs ( although I think Metallica has been so bland for years and wouldn't REALLY download it for my listening pleasure) and come to my house and find me. I would most certainly take that punk OUT! [​IMG]

    It doesn't matter. There will always be piracy.

    Of all RCD's sold, what percentage are actually used for legal purposes?
    To back up harddrives? right.
    To transport large files? ZIP drive
    Zip drives were the replacement for floppy drives, except CDR took over.

    Cd recordables were made to pirate. Why? Because its profitable. Regardless of the encryption method (DVD is a prime example), multi media is going to be copied.

    Why are MP3 players made? How many people actually own the CD's or are actually using music that is public domain?

    Well, I just used Imesh to download about 110 slow songs from the 80's and 90's. It seemed to work pretty well.

    I don't recall receiving one transfer error (like with Napster), and the songs downloaded pretty quickly.

    I tried Bearshare and Limewire, but they both sucked. Imesh is the way to go!!!!

    They tried to ban them. They had this debate back when Diamond Rio released their first MP3 player the record labels went to the courts to get an injuction to prevent them from going on sale but they failed.

    If they can't ban MP3 players then they shouldn't be allowed to ban Napster (which is essentially what they have done).

    Do you even know the legal problem behind Napster? The difference between Napster and an MP3 player is the same as the difference between shooting a gun and owning a gun.

    Napster is a business built on actively and knowingly participating in the distribution of illegal products. Each file copied goes through Napster servers and is facilitated by the company. You don't see the problem here?

    Actually, I don't think they need to worry about this. As long as they can stop major distributors like Napster, people would still be able to "preview" music. The last CD I bought (Metallica "S&M" Album), I previewed (the whole CD) it on the band's website. The next CD I plan on purchasing (Megadeth's "The World Need's a Hero"), I am semi doing the same thing (they put one different song on the 'net every 4 days or so). In time, every band that has its own website will preview its music through that medium, and there will no longer be an excuse to use Napster as "previewing" tool.

    When the .mp3 format was created, it was supposed to be used as a previewing technique. Many websites have discalimers that say you must delete the file after 24 hours.

    Totally agreed. Of course, you have to click ACCEPT on software agreements saying you won't let anyone else use it also and we all know that software pirating is a real problem for the software industry.

    After all this Napster debate and court proceedings...I just downloaded imesh. I got the idea from one of these postings.
    WOW!Imesh ROCKS!!!! Audio, video, JPGs EVERTHING!!!!!!!
    What good,if any, did all this Napster court stuff do? Dang-Nabbit! This crap is outta control.
