Homework help with lawsuits PLEASE!

    Anyone know of any lawsuits filed by sports fans at a game. Lawsuits filed because of negligence on the part of the sports teams. You know, someone hit by a baseball or hockey puck, etc., that filed a lawsuit against the team. Or any other kinds of lawsuits (negligence) filed by fans? I tried searching the web, but I couldnt find anything.

    Also do you know of any lawsuits that are already decided? You know, ones that are not in the courts. Ones where the judge or jury already has decided in someones favor?

    Also what search engine do you use? I am not exactly a master at this kind of stuff.

    Because I also need to do some research for other classes (Bali Indonesia Marketing Program). I would appreciate any help anyone can give me.

    This is Canadian, and not directly related to game action, but some Canadian fans from Ottaway filed a suit because their star player, Alexander Yashin, decided to hold our for more money. The judge upheld its validity.

    I remember like a year ago two lesbians were kicked out of a Dodger game for making out with each other - I believe they sued the team and got like season tickets or something. But I don't even know if that's related.

    Aren't you supposed to do your own research for this homework project, ROckets03? BTW, you are unlikely to find lawsuits filed won by fans against teams when players are hit by batted balls, pucks, etc. There's a waiver printed on the back of your ticket that covers those situations.

    I'm pretty sure the fan involved in the Cubs-Dodgers brawl last year sued and eventually settled out of court. I don't know why he sued, he was the one who started the whole thing.

    It wasnt the Padres, it was the Marlins like R95 said.

    There was a case where a woman sued a baseball team after being hit with a baseball coming from the bullpen. The team had lowered the netting around the bullpen or something like that. I was thinking that she won, but I can't find the story.

    The only one that I could find right away is an old (1950) Missouri case called Anderson v. Kansas City Baseball Club. The court held that the fan struck by a foul ball had assumed the "neccessary and inherent" risk by going to the game, and found for the defendant.

    Hope I'm not too late to help out a little. I took sports law in law school and we studied a lot of this stuff. Generally when you go to a baseball game you assume risk. Assumption of risk is like the major tenent of sports law. It prevents players from being able to collect for most of their injuries..and it prevents fans from collecting against teams when they get hit by a ball. The little disclaimer on the back of the ticket says that...however, that's not why the law exists like that. If I remember right, the line of thinking that you contracted to pass away your right to sue simply because you bought a ticket which had some tiny boilerplate on the back of it didn't prevail.

    By the way...the season ticket holders who sued the Marlins lost. The possiblity that your team may suck always exists when you buy season tickets. And you can't show that even if they had kept the exact same lineup that they would have won. Trading players is part of the game, and everyone knows it. I believe the guy sued saying that it was deceptive that they used pictures of Alou and others they traded away on season ticket renewal forms. Can you imagine the number of lawsuits around the country if the Marlins had lost this suit?? Selling season tickets would be too great a risk if fans could sue simply because they didn't like the offseason moves the team made. And what the hell were his damages??? How was he damaged because the Marlins sucked??? He still had tickets to a baseball game...no one can guarantee that a team is going to win, with or without those players. Especially when you consider the possiblity of injury.
