Supreme Court rules 5-4 that juveniles cannot be executed

    WASHINGTON (AP) - The Supreme Court ruled Tuesday that the Constitution forbids the execution of killers who were under 18 when they committed their crimes, ending a practice used in 19 states.

    The 5-4 decision throws out the death sentences of about 70 juvenile murderers and bars states from seeking to execute minors for future crimes.

    The executions, the court said, were unconstitutionally cruel.

    Am I the only one that's interested when the SC is in session? I rarely pay attention to other court rulings b/c if it matters, the SC will handle it (if I could photoshop, you know where this would be heading). Anyway, probably the right ruling, though i'm pretty indifferent on the death penalty anyway...

    How forward of them....still can't beleive that 4 Justices think it's a-ok to execute juveniles

    I'm also starting to like the supreme court cases, mostly because we have a particularly interesting supreme court.

    concerning the 4 dissenting judges, if you read their opinions you can really see the encapsulation of their argument and understand where they're coming from (most of the time). Scalia is a great conservative judge, and even though I don't agree with him often, he is very consistent and very rule based. His main arguments didn't necessarily focus on his opinion on executing juveniles, rather that he says the rules are there, have been there and the states made the decisions to make their rules. Scalia is a very rules based kinda-guy, rarely will he look at the morality of the issue and will instead look at rules themselves and see if they are actually unconstitutional or not, usually he is very lenient in allowing states to decide their own rules and keep their old ones. Despite that I don't agree with him all the time, i think he's a great and necessary person to have as a justice in the SC.

    I wish they would eliminate the death penalty all together. It is cheaper, more effective, and more morally justifiable to imprison people for life than to execute them.

    Yep. With all of the expensive appeals, the increased cost of housing a prisoner on death row instead of in the general population, etc. it costs up to $600,000 more to execute a prisoner than it does to keep them in prison for life (or so I have read).
