    NEW YORK (Reuters) - New Jersey Attorney General Peter Harvey says he has filed a lawsuit accusing Blockbuster, the nation's top movie renter, of deceiving customers with its new "No More Late Fees" rental policy.

    In a statement outlining his complaint, Harvey accused Blockbuster of failing to disclose key terms of the policy and said that some of its stores did not participate in the policy and continued to charge late fees.

    "Blockbuster boldly announced its 'No More Late Fees' policy, but has not told customers about the big fees they are charged if they keep videos or games for more than a week after they are due," said Harvey in the statement on Friday.

    "Blockbuster's ads are fraudulent and deceptive," he added.

    Blockbuster -- currently locked in a bitter takeover battle for No. 2 U.S. movie renter Hollywood Entertainment -- unveiled its "No More Late Fees" policy in December in an attempt to jump-start its business as competition escalates.

    Blockbuster at the time had said that under the new plan customers would have a one-week grace period after a rental due date. If a movie or game were not returned during that week, the customer would be charged for the purchase of the item. If the item was then returned within 30 days, the customer would be able to receive an account credit, but be charged a restocking fee of $1.25 (66 pence).

    Harvey said the state is seeking restitution for Blockbuster customers whose overdue rentals were converted to sales, were charged restocking fees and/or charged late fees by a non-participating store.

    The state also seeks civil penalties of up to $10,000 for each violation of the Consumer Fraud Act.

    Blockbuster spokeswoman Karen Raskopf said the company was surprised that New Jersey attorney general's office "never directly contacted us about this" before filing the lawsuit.

    She said Blockbuster stood by its new policy and has done everything to explain to customers how it works.

    "We are disappointed he took this action because we believe the end of late fees program is a terrific program and we've received tremendous feedback from our customers and employees," Raskopf said.

    Blockbuster has been facing increasing competition from discount retailer Wal-Mart Stores Inc. and online companies like Netflix. Blockbuster in October had cut its fee for online DVD rentals, in response to a similar move by Netflix.

    Its shares were up 6 cents at $9.14 in midday trade on the New York Stock Exchange (news - web sites).

    I still have acopy of Top Gun for Nintendo. No not the Nintendo 64 or even the Super Nintendo. We are talking original Duck Hunt/Mario Brothers Nintendo Game system.

    I think I would owe some late fees on that.

    Or, on the contrary. I happen to have some tapes out that were "due" four days ago. I'm watching the time. I was too busy to watch this movie but wanted to give myself one more chance this weekend. It's not "lazy" so much as busy. (and, no, there is no good excuse for me to be posting on clutchfans at all this semester... but I do, because it requires less energy than getting up out of the computer chair)

    Those three people posting the same thing at once was absolutely freaky. Maybe there is some truth to that collective unconscious theory. :)

    Anyway, my Critical Thinking class will be glad to have an update on the Blockbuster story, since I've been using it as an example of false advertising.

    That was the same thing that came to my mind when I first read the post. Glad I wasn't the only one who didn't know how to land the damn planes.

    Sounds like the NJ Attny Gen has too much time on his hands.

    What a joke. You keep the thing a month...bring it back...and they only charge you an extra $1.20 something. Give me a break. Yeah...the consumers are being oppressed by this policy.

    I got to be really good at landing the plane after a while. Once you figure it out, it's not so bad, but it was impossible at first. I never finished the final mission though. Honest to God, I still have a photo of the screen that shows after you die on the last mission.

    After the first week they bill your card on file the amout it cost to buy it new, so if I have 3 games out a week after the due date I get hit with a 150.00 charge... I could see why people would be mad just because they have all the billing mess and watching their account to make sure they get thier money back...
