If they ever went before a (real) judge again, they could argue that their arrest was illegal and the court would probably throw the whole thing out. But, they never will see a judge again because they would have final orders from the ALJ and be deported. So, yeah, they would have to sue. And sue from abroad. After their life was turned upside down and they were impoverished by their deportation. But, there are legal nonprofits looking around for cases to sue the federal government over. Where are they?

That said, I fear what SCOTUS would do with the case if it got to them. Would they just neuter the 4th amendment? I wouldn't put it past them.

 

You are thinking a U.S. citizen case doesn't matter to the "illegal with final order for removal" case? I think they are intertwined, because that case showed it impacted a U.S. citizen, even if the administration intended it to apply only to immigrants with a final order of removal. A SCOTUS ruling that the 4A doesn't apply to immigrants with a final order of removal would be narrow, and I can see it happening with this Court, but that would also be a backdoor into your, my, and every citizen's home. SCOTUS thinking far ahead about the implications of its decision is... well, see the Kavanaugh stop, which he later backtracked on.
