ICE murders civilian in Minneapolis

    One shot to the tire would have be fine. The more I see, the more I think this was uncalled for. But I wasn't there so moot point.

    At the time he pulled his gun and unloaded he was standing next to the drivers side with nobody in front of the vehicle. She was fleeing. 0 demonstratable imminent threat to anybody.

    He's basically going to have to claim "heat of the moment". He's probably shielded from prosicution by Federal enablers for now, but there is no statute of limitations on murder or manslaughter so he might consider moving to a non-extradition country.

    Ok fair enough, my mistake, but he discharged his gun twice as she was driving away from him. Both of the bullet trajectories are NOT going to have entered her body from the front. They'll be entry from the back and side. There was no imminent danger to anybody when he pulled the trigger.

    If a Democrat who believes in rule of law ever returns to the Executive branch, Deputy Dog's going to see a lengthy murder trial at least. I suspect he won't fair so well, but we'll see. Probably he'd get away with it in front of a jury in the deep south. Doubt he gets the same treatment in the "liberal shithole" of Minneapolis.

    I think he deserves time but legally he has an argument. Doesn’t mean it’s a good one morally. I’m good with either legal outcome objectively.

    Don’t come into America illegally and don’t try to run over federal agents with your car. Pretty easy to avoid being shot. Liberals know this if they are being honest about things — which they rarely are.

    we’ll see if the ICE scum even gets arrested and charged…very good chance he doesn’t

    the ICE trash that shot that woman 5 times in Chicago and lied about the entire encounter is still out there scot free…no arrest…no charges…no repercussions…no nothing

    and that shooting was arguably worse than this one, she just so happened to manage to survive

    I'm not a lawyer. I asked an AI about jurisdiction. It indicates that even if charges are brought by the state, the charges would almost definitely be elevated to a Federal court, where the totally unbiased DOJ could slow walk them, presumably court shop and then sabatoge the prosecution so that the charges disapear.

    1. State Prosecution (Hennepin County)
    The Hennepin County Attorney’s Office has already stated they have the jurisdiction to bring state-level charges (such as murder or manslaughter). However, a state prosecution of a federal agent rarely stays in state court.

    • Removal to Federal Court: Under 28 U.S.C. § 1442, federal agents have the right to "remove" any state criminal prosecution against them to a U.S. District Court.
    • The Logic: This ensures that federal officers are not subjected to local bias or "hostile" local laws while performing their federal duties.
    2. The "Supremacy Clause" Defense
    Once in federal court, the agent’s lawyers would likely argue for Supremacy Clause Immunity. This is a powerful legal shield based on the U.S. Constitution.

    • The Test: To get the case dismissed, the agent must prove they were (1) performing an act authorized by federal law and (2) that their actions were "necessary and proper" to fulfill their duties.
    • The Result: If a federal judge decides the agent’s use of force was a "reasonable" split-second decision—even if it violated state law—the state charges can be dismissed entirely before a trial even begins. This happened in the famous Ruby Ridge case.

    If that's correct, to prosecute him now, you are going to have to put your faith in the honesty and integrity of the Pam Bondi DOJ to follow through against one of her own brownshirts, which I personally find a bit quixotic at the moment. And if you do that, and Bondi kills the prosecution, you can't try for the same crime twice. It seems much safer to wait for 2028 (or however many years it takes to reestablish the genuine rule of law), to me.
