He admitted to having sex with her. He also admitted that they never spoke to each other. Textbook definition of rape.
Cannot say much besides this party in and of itself sounds fishy as **** and no conversation was had, yet she was passed out drunk and there was still any form of sex? Disgusting and Ben should not have put himself in this position…what an idiot, especially if technically it’s not rape and his version is true.
I don't see how reasonable doubt wasn't established with the only witness being drunk. I'm not sure why you have to speak to give consent. Is there like a contract to sign as well? Usually if a woman doesn't want to she makes it obvious. Also, in her state, she wouldn't know what she did or said, right? What if she motioned something to him that made him think there was consent? Where are the other women if this was something he was doing? Sometimes the law just doesn't allow for justice. She should have done civil trial with lower burden of proof. Similar to the he said she said case at Baylor with difference being they had prior relationship. He was found not guilty after his draft stock was taken from him. He never got that 2nd round money back.
Bruh... I normally like some of your takes, but... One of the key differences here was the lack of consent. He said she made the first move, but he also admits they never spoke. The BEST thing he could've done was go home b/c IIRC his wife was literally blowing up his phone at the time this was happening.
If he could prove that they were both on drugs and booze, that would have helped him. He has time now to think about his choices.
Nobody knew who Ben McLemore was ....he couldn't pull the celeb card off ...... What a dumb way to go into retirement. I hardly remember him playing, I am sure he played for the Rockets during the Harden years. I only know that he played uninspiring basketball when he was a King but who wasn't.
Yeah this whole sex with a drunk chick isn’t rape excuse needs to die forever. This isn’t Revenge of the Nerds anymore. We as a culture need to protect people from being taken advantage of PERIOD.
It doesn't have to be verbal, but it needs to be communicated. The facts of this case seem to be that she woke up to him raping her. Why so many people are so eager to go to bar for shitheads like Ben McLemore, found guilty of rape by a jury of his peers, is beyond me
