Jeff, I always thought the "sodomy" law applied to heterosexual activities as well. I too think the gov't should not make laws dealing with a person's private life, but they do it all the time: seat belts, helmets, drugs, etc...
Yah, I always thought that the Texas sodomy law applied to everyone--straights and gays alike--and not just to what we would typically define as sodomy, but to other sex acts too that were described as "unnatural." An appeals court today dismissed a case against two gay men who were arrested for violating Texas' anti-sodomy law. The court said the law was a violation of the constitution and was un-enforcable. The court said that the law is unconstitutional because it descriminates between who is performing the sexual act. In other words, a man and a woman can engage in sodomy but two men cannot. I've always found these laws particularly troubling because it allows the state access to our most private lives. I have friends who are gay and lesbian and, while these laws are most offensive to them, they bother me just as much. This law was waiting to be challenged anyway. It's been on the books forever but NO ONE had ever been arrested using it - at least not in the modern era.
