In a immigration court, which is part of the executive branch and is a rubberstamper for executive branch policies, they took the claims at face value as true. The claims were that he wore a Chicago Bulls uniform, had cash at Home Depot while loitering to find day labor and an informant said he was a prominent MS13 gang member in Long Island, a place he has never been to.

When it went to federal courts that are not part of the executive branch like immigration courts are, the court asked for more evidence from the executive branch that he is a member of ms13 as the current evidence is non existent and the government was never able to bring forth more evidence. The admin decided to not proceed further with the due process of giving more evidence to the court to determine if he is a gang member and did YOLO and just flew him to a concentration camp

Also the detective who filed the report is now a disgraced fired cop because of using poor informants and lose allegations to arrest.

 

Yes, I'll ignore minor civil violations like cops do all the time every day including for you. Because if I took out the ECU from your vehicle I guarantee that I'll fund more delinquent behavior than almost all the 200+ migrants shipped to CECOT this past month.

You guys do understand immigration courts are part of the executive branch right? That means Trump is literally the boss of the judges of these courts. So in 2019, under Trump a immigration court used evidence that made a cop get fired for poor police work that he was a gang member that didn't fly when same evidence was used in a federal court where the president isn't the boss of said judge.

They have a valid deportation order to any country except El Salvador. He had a ton of immigration court due process already that many haven't had or won't get. Now people are contesting the findings and saying that he isn't MS-13, which is more a moral argument than a legal one, as a judge already found that there was enough evidence to tie him to that and deport him years ago. There was just deportation protection against El Salvador.

This was an administrative error that could have been corrected by bringing him back and deporting him to Panama where many others have been sent. But instead of trying to follow the law and correct their errors, Trump admin really is just doing king stuff when we don't have a king system. It's not like Bukele didn't send back a plane full of people from the wrong countries and also women who got mistakenly sent there.

 

you keep bringing up lincoln, but isnt lincolns suspension of habeas corpus considered one of if not the biggest stain on his presidency? also, and not to state the obvious, but he did it during the civil war...lincoln justified what he did as being in service to the war effort or to protect supply lines. not uncommon in war-time to declare martial law. jackson did it at new orleans.

comparing what trump is doing vs what lincoln did is not an apples-to-apples comparison.

Do you know what a immigration court is even? Do you know what branch an immigration court is under?

US Federal Courts literally demanded the government to provide actual evidence of the claim that he is of MS13 because the immigration courts used evidence from a cop who literally got fired for using bad faith informant tactics. Garcia was loitering in front of Home Depot looking for day labor(the reason cops were called) and had cash on him. He also was wearing a Chicago Bulls jersey. An "informant" claimed he was a prominent member of MS13 in Long Island, a place he has never stepped foot in. The Bulls Jersey, the claim he was a member of MS13 Long Island branch and him loitering with cash while looking for day labor at a Home Depot were the three pieces of evidence and THE ONLY THREE pieces of evidence used to claim he was from MS13.

Again it was proven the informant was full of **** because again, Garcia never has even been to Long Island let alone being a prominent member of MS 13 in Long Island. A Chicago Bulls Jersey doesn't make you MS13.

An Immigration court judge follows the orders of the president. There is no independence between the executive and immigration court. As soon as this "evidence" was tried in front of an actual independent federal court judge they were like " Ya so the government needs to provide actual evidence that he is part of MS13 because this isn't evidence".

 

Lincoln suspended civil liberties because the normal judicial process could not meet the the circumstances he faced.

The normal judicial process cannot meet the current circumstances of dealing with 10+ million illegal immigrants and the violations of our federal laws they represent.

Yes I hate it when Trump ignores basic civil rights to expand executive powers to eventually label American citizens he doesn't like as illegal gang members and ship them off to a foreign concentration camp and tell the Supreme Court "My bad... too late, its a foreign policy issue now" when they rule that the citizen needs to be returned back.
