There's always some deadbeat dad who all of a sudden cares about their kid after having nothing to do with them their whole life when they see dollar signs. They pop up out of nowhere when their son signs to the NFL, NBA, or any other type profession that makes them instantly wealthy.
Honest answer would be the witnesses who helped subdue the man. At least what they said to the media seems to track that their testimony would be very helpful to Penny. Multiple things can be true though. Penny shouldn’t have used a choke hold to subdue the man and it’s likely that him and the others helping subdue the man had no idea he was in real danger of dying. If you know about chokeholds though with experience in something like jujitsu you know that it’s dangerous especially after longer than a few seconds. To me voluntary or involuntary manslaughter probably was the right charge but I’m not the prosecutor or the jury so it’s just my opinion. I don’t think he’s the hero the right thinks he is and I don’t think he comes off as a blood thirsty murderer either. Guy thought he was doing the right thing in the moment but went too far.
I brought this up earlier and why I said there is reasonable doubt. Chokeholds put in for an excessive time are dangerous. You can out off the air or blood supply to someone’s brain for a long period without it causing damage. The question to me though was how long was the actual hold on and how much did Penny know that he was or could likely be killing Neely? Even though Penny was a former Marine he is still a civilian and not an LEO so this situation isn’t the same as The killing of George Floyd where Chauvin had been trained and was exceeding that training in continuing the hold on. Also while it was initially reported they Penny had Neely in the hold for 15 minutes it’s not clear to me they was the case and how long the struggle was on before the hold was actually on.
