If there was a runner on base, that is a balk for the catcher being out of the catcher's box. As the catcher is required to be in the catcher's box when the ball leaves the pitcher's hand (except on intentional base on balls), I don't see how this is a legal pitch and as such should have been called a ball when no one is on. The catcher's box is a stupid rule, though.
I think he was allowed when Garcia was told no but I thought he did this earlier on in the season and MLB told him to knock it off. *edit he did this but did a pump fake. Mlb said no to the pump fake but everything else is fine.
