rape shield laws govern the admissibility of testimony/evidence at a rape trial. they do not govern the ability of news outlets to do anything.

I just believe she finally showed what she is really after. I don't believe Kobe raped her, but I imagine that her lawyers will be able to convince a jury that she deserves some money for her "pain and suffering." If that was offensive, my apologies, but I call 'em like I see them. What was she doing in that room? Why did she have sexual relations with someone not long afterwards? DNA evidence proved that. I smell an obvious rat. And it's not just because he's a NBA player. Nobody deserves to get taken to court over some consensual sex and be forced to pay a woman money for dragging YOUR name through the mud in a he-said, she said circus.

the civil trial will never make it to depositions. kobe's lawyers will force settlement. the alleged victim will never be deposed. they're just going to haggle about how much. and a few mil, even 10 mil, is nothing to kobe, even after his wife dumps his ass and takes her share.
I just hate to have to see him pay that, for nothing. His only crime was between him and that beautiful wife of his (why would he cheat on her?). He's an adulterous scumbag, but does that mean some woman in Colorado should profit from that fact? No.
on Fox i heard that she will only get about 733k because of the limits that Colorado has placed on punitive damages. She will probably file false imprisonment, intentional infliction of emotional distress, defamation, and assault and battery. soooo if anyone can find out what the max penalties are for those torts in colorado then we can gauge how much money she will come out with.
Yea, the civil case will most likely be settled as soon as the criminal case is dropped. only like 2% of all cases make it to the actual trial.

Hmmmmmm......... - The case against him is falling apart like Jon Koncak guarding Shaq, so they're going to let the criminal case go and move to a civil proceeding, where she will likely get a nice settlement. - I never said he was a saint. I called him an adulterous b*stard. Don't think I beatified him there.... He doesn't deserve to pay this golddigger one red cent for a night of consenual sex. In fact, he is the one that should be suing HER for his lost endorsements. The facts are overwhelmingly in his corner.
settlement value is not entirely based on the maximum recoverable amount. you must take into account the desir to avoid publicity, impact on the defendant's business (endorsements), a bunch of other stuff that has little if anything to do with the actual merits of the claims. you can bet that kobe's lawyers will demand an iron clad confidentiality agreement where she cannot disclose the terms fo the settlement and if she does, she will be subject to the maximum penalties/liquidated damages enforceable by law.
Accuser's friend says she's a freak - here's the latest from the NY Post: ACCUSER CAUGHT IN WEB By BARRY BORTNICK -------------------------------------------------------------------------------- August 11, 2004 -- A former college pal of Kobe Bryant's accuser is defending the NBA star on the Internet, where she's posted sordid allegations about his alleged victim's past, including what she claims was a plot to have sex with the rapper Eminem. In a phone interview with The Post, Laie Weatherwax, who has been informed she'll be called to testify for the defense at Bryant's trial, said yesterday: "I am doing this because it is right." The self-described former wild child, who partied with the accuser for eight months while the two attended the University of Northern Colorado nearly two years ago, said, "There is no motive here [for me]. I think that it is the right thing to do." The alleged victim's attorneys have accused the defense of wrongly portraying her as a wildly promiscuous woman. She's a fairly typical teen and she made a mistake [by going to Bryant's room on the night of the alleged rape]." Citing a gag order, Wood declined to comment on Weatherwax's allegations.
