    The people voted 64% in favor, but the council responded: "you voted wrong".

    Harker Heights council repeals new mar1juana ordinance


    HARKER HEIGHTS — The Harker Heights City Council relegated its new mar1juana decriminalization ordinance to the ashtray Tuesday night, repealing a measure passed by a solid majority of the voters in the city’s Nov. 8 election.

    Mayor Pro Tem Jennifer McCann, Councilmen Michael Blomquist, Tony Canterino, and Sam Halabi voted for repeal while Councilwoman Lynda Nash was the only dissenting vote to keep the ordinance in a 4-1 vote.

    At least nine individuals spoke at Tuesday night’s meeting for and against repealing the ordinance.
    Vitalis Dubininkas said he uses cannabis for health reasons, and compared the council’s impending repeal vote to the prohibition era. He said the council should keep the ordinance.

    So what was the point of the vote if they were just gonna repeal the outcome they didn’t like?

    criminalizing mar1juana is so stupid

    I don't understand this. mar1juana criminalization is state law. I'm not sure it makes much practical difference.

    Seems it has.

    "Some cities in Texas allow for officers to cite and release mar1juana possession suspects.

    Other cities such as Elgin, San Marcos and Austin have fully enforced the will of voters on decriminalizing mar1juana in recent elections, with no apparent action to stop them by state officials."

    But it would seem to me it is still up to the head of law enforcement to decide if they will enforce or not. If they don't want to, they can try to hide behind the ordinance; if they want to, they tell city council they're just enforcing state law. Meanwhile you might have Texas Rangers or county sheriffs come arrest people for mar1juana because they don't care about city ordinances.

    I'm guessing the ordinance ends arrests by local PD. The State knows, so they could try to legally fight it. I very much doubt they would send over State officers to crack down on the local folks without a legal fight first.

    But if local police chief wants to enforce state law, he can. Maybe mayor can fire him if he does, but it's an executive matter, not a legislative one. I guess it'll have an effect because it tells a mayor and a police chief that their residents don't want this and maybe they will respect the people's wishes.

    Local PD always has the option of selective or no enforcement. When a local gov body has a requirement of no enforcement, I think they would not ignore that unless doing so actually breaks the law (it doesn’t in this case).

    What happens if there is a no-enforcement ordinance and the police chief arrests someone anyway, citing state law? Is there any legal repercussion for the PD?

    Whatever is the repercussion for not following local ordinance (fired, losing reelection, nothing).
