Too strict regarding bail = people complain it’s an injustice… the public is outraged Not strict enough on bail = inevitably someone kills someone while out on low bail/no bail… people complain the system failed… the public is outraged Impossible to win
Or ... Here me out Crime is cyclical in nature and matches the cyclical nature of our economic system. When recession hits or a pandemic, crime goes up. After a while it stabilizes and dips back down. The right takes advantage of the lizard part of the human brain and will attribute long term systemic issues of crime with simplistic diagnosis and answers(an actual aspect of fascism btw... Simplistic solutions to complex issues like crime) like bail reform when all data shows that every place in the country with and without bail reform has seen an uptick in crime and all those same places will see a decrease over time if the economy and inflation recovers with or without any repeal of bail reform.
I never understood why release was contingent on one's ability to pay a bail. You either deserve to be let out or you don't. The problem is people being released who should not be (which is definitely not a fake concern), not the bail amount.
