The cowards on the court not signing their names to this radical activist legislation from the bench should be known as the Coathanger Court. Chief Justice Roberts, seemingly aware of how this decision will stain American justice for decades, will unfortunately have his name tied to this unconstitutional decision.
I hope you are right about the Texas monstrosity being overturned, but this bizarre ruling gives me no confidence whatsoever. If the attempted assault on the rights of women from the Texas GOP doesn't fly, these 5 SC judges will pick another Roe case to hang their hat on. They have made that perfectly clear with this ruling, in my opinion. Roberts was ignored. That says it all.
This is politically stupid for Florida and the GOP. Miami Dade will go right back to solid blue and could flip Florida back to toss up status easily. Miami Dade is an area that had momentum towards being more anti Dem due to the propaganda being spewed on AM radio and via internet nonsense... However this law will break through and offset those gains they have made. There's a reason why the Heritage Foundation and the GOP organized this so that it happened this way in the middle of the night. If states like Florida get overzealous, and this becomes the storm that I think it will once these videos start coming out of nutcase vigilantes winning bounties for turning in black and brown young women who are only 7 weeks pregnant, it's going to blow up right in time for the mid terms. The right wing braintrust wants this to be quiet... but it's not going to be quiet at all. This is only going to get louder and louder.
Except I don't have confidence in the democrats to take advantage. Democrats suck at playing politics, they don't play dirty enough, unlike republicans.
Is it a cynical B.S. lack of action from any logical jurisprudence standpoint? Yes. Mostly, it was the 5th circuit's crazy Trump panel that really went off the walls here. I agree with you that those 5 judges are looking for a good case to hang their hat on. This case isn't it, but it was good enough for them to buy time due to the creative BS aspects of the law.
I mean, they didn't agree with this take technically. Technically, they just said let's wait and figure out if we're suing the right people. But cynically, it's obvious that everyone on the SC knows this is messed up, the law is an obvious work-around, everything is super unconstititutional, but the conservatives who didn't like Roe don't mind having chaos until this law ultimately gets struck down. So for all intents and purposes, that guy's take is correct, but the SC said screw reality and let's for once deal with technicalities (they didn't do this for anything else all year).
this is going to blow up in the right's face big time...bad decision and hill to die on. You're not going to fool something the majority of the coutnry stands for on a technicality
I don't see why a blue state couldn't deputize its own citizens into turning in Texas citizens who travel into the blue state who also attempted to collect a bounty - like basically a bounty on the bounty hunters. I mean, it's ****ing stupid as hell, but since you don't have to show a concrete harm anymore, the court wouldn't be able to do anything about it until it actually happened, under the midnight rule.
nay this is more on McConnell for stealing a seat and on senators and voters believing the lies of judicial nominees saying they would respect precedents and not overturn Roe v Wade.
Agree. If trump could defeat HRC, many others would have too. And McConnell would still install the same justices.
