    Of course brother, but this movie was meant to be theatrical, like the other MCU movies.
    Streaming usually comes WAY LATER. They changed this quickly because of COVID and shut down of theaters. Her contract was negotiated PRE COVID.

    This is what the deal is

    To maximize these receipts, and thereby protect her financial interests, Ms. Johansson extracted a promise from Marvel that the release of the picture would be a "theatrical release." As Ms. Johansson, Disney, Marvel, and most everyone else in Hollywood knows, a "theatrical release" is a release that is exclusive to movie theaters. Disney was well aware of this promise, but nonetheless directed Marvel to violate its pledge and instead release the picture on the Disney+ streaming service the very same day it was released in movie theaters.

    Despite Disney's claim that the online release gave Johansson "additional compensation," one "person familiar with details of her contract" told The Wall Street Journal that Disney's "decision to put the movie on Disney+ is projected to cost Ms. Johansson more than $50 million."

    The disagreement isn't around streaming or not, but that streaming started too early. Future contracts would have to account for that to avoid a situation like this.

    this opens up the floodgates for stars not happy with the cut in the past year due to simultaneous release on streaming and theater.

    Will this lawsuit stand up in court if that “promise” isn’t written in the contract?

    Edit: ah, the article does say “a wide theatrical release” was in the contract:

    The case may come down to how the phrase "wide theatrical release" is defined. The contract clause cited by Johansson doesn't explicitly state that the film could not be released online and in theaters—it says, "if Producer in its sole discretion determines to release the Picture, then such release shall be a wide theatrical release of the Picture (i.e., no less than 1,500 screens)."

    I think Disney may win this. “Theatrical release” was commonly understood as exclusively theatrical because that was the release model at the time. But if “exclusive” isn’t in the contract, I don’t think it can be argued that it precludes simultaneous streaming release. So long as they are making it available widely in theaters, they’ve fulfilled the letter of the contract.

    And guarantees that Scarlett Johansson has done her last Marvel/Disney film. This is NOT in the best interest of either Disney or Scarlett Johansson. I am guessing that this will get settled.

    Plus they are trying to shame Scarlett in public by mentioning her salary and COVID
    for sympathy points so they don't have to pay her $50 mill that she would have made if it was a theater only release and released on time.

    She will need to prove that Black Widow would not have bombed in theaters to show damages right?

    Disney is probably screwed because they didn't even try to release in theaters but I believe the movie would bombed in the current DeltaRona situation so not sure what she deserves to be paid.

    We all know it's somewhere in between what she was paid and what she would have been paid under normal circumstances. Disney will pay her more but how much more is what the legal process is determining. There is no good or bad guy. It's just business negotiation. That being said, Disney would not have payed a cent more unless this suit was filed.
