    It seems that:

    DA says not enough evidence, so you can testify in civil trial
    Cosby testifies in civil trial and gives incriminating evidence
    new DA uses civil trial testimony in new criminal trial
    Cosby found guilty

    The whole thing this is weird. You shouldn't be able to make a promise to never prosecute. Cosby shouldn't be using a verbal promise to make a decision on what to say in a civil trial.

    But if you believe the sequence of events, Cosby probably isn't ever tried if he doesn't say whatever he said in the civil trial. What he said in the civil trial or why he'd say something incriminating, I have no idea (and don't care enough to research).

    Trump lawyer Bruce Castor plays a central role in Bill Cosby going free - The Washington Post

    The crux of the ruling is this: Castor had said he had a deal with Cosby saying Cosby wouldn’t be charged criminally for the sexual assault claimed by Andrea Constand. Castor said he did so to prevent Cosby from pleading the Fifth Amendment in ongoing civil litigation. The Pennsylvania Supreme Court ruled that charging Cosby for that crime, for which he was later convicted, violated his due-process rights.

    Evidently they tried to have it both ways
    This would be like using a CI (Snitch) to get information and rat out someone else
    then use the same information to prosecute the snitch too

    You make a deal . . .your office has to stick to it .. .
    They felt since the OLD DA Made the deal they didn't have to uphold the deal
    but . . .the MAN did not make the deal . .the OFFICE made the deal
