    My understanding of this is because the prosecution didn't enter into evidence carbon monoxide levels that they can't do so now on rebuttal.

    In other news Chauvin has declined to testify. My own opinion is this was the right call for him as him testifying opens him up to cross from prosecution and potentially to his own history of complaints regarding use of force.

    Judge Cahill is upset that the medical examiner's office did not turn over all of its test results until the 11th hour, and says the prosecution cannot bring up the newly disclosed evidence regarding carbon monoxide levels in George Floyd's blood if they put their expert medical witness, Dr. Martin Tobin, back on the stand. “If he even hints that there are test results that the jury has not heard of, it’s going to be a mistrial,” the judge says.

    Though the prosecution wants to cover every possible base, it’s not clear that this decision will be a big blow to their case, because Dr. Fowler, the defense medical expert, listed carbon monoxide poisoning as only one of several possible factors in Floyd’s death, and the state already undermined that theory on cross-examination.

    Now that both sides have presented their cases I'm hearing from most legal analysts is that the prosecution has put on a very strong case. Analysts are talking about the possibility of a hung jury with maybe one juror holding out but very little about an outright acquittal for Chauvin. Juror nullification might be an issue here.

    My guess is that the judge will be loathe to accept a hung jury and likely will keep the jury sequestered for a long time to try to get a verdict.

    ...but to be fair...if those cops had gotten to this guy by the time he turned, say, 13 years old or so...

    ...(better yet, even twelve, like one Tamir Rice)...

    ...they could have just shot him and blamed it on his parenting and nobody would have batted an eyelash at it...

    ...maybe.

    Might be why, as well, that there's rarely ever any reporting of "unarmed-white-people-getting-shot-by-police-officers-at-traffic-stops"...

    ...'cause they don't ever seem to be UNarmed...
