And let capitalism play out and allow private companies to refuse service to people who refuse to get vaccines or sedle if you can pass legislation that adds "people who don't believe in modern medicine" as a protected class like race, age or veteran status.

Prıvate companies cannot refuse service to people who get a vaccine or don't get one because they have no right to know their customer's medical history. Also just saying "muh private company" is a convenient excuse when they literally become tyrannical. There are times the legal system should step in and put a stop to abuses; especially when large corporate entities which are richer than many nations begin abusing people. You can't just "muh private company" for everything they do.

So then in your legal opinion, the businesses in NY that require you to flash your mobile excelsior pass (or your vaccine card) in order to enter their business is breaking the law? When I went to Hawaii and played golf, did the golf course break the law when they required me to show my negative COVID test in order to play? What about the resort I stayed in? National Car Rental? "People without vaccines" are not a protected group under Federal Law as it stands. You can absolutely bar them from your premises, just like you could someone with terrible hygiene. Federal Law requires a certain level of employee safety. How do you determine who has been vaccinated?
