    The bars LOVE Dram shop laws because their liability is capped at a pretty low monetary level. The bars and restaurants have fought and lobbied hard for Dram laws for some time because it is so little.

    The bar being liable doesn’t prevent the drunk from being liable as well. Most jurisdictions have comparative fault.

    There's no point to this hypothetical, the victim is not the killer.

    The family of the dead person can't bring their dead kin back, but they can certainly hold the killer responsible.

    How much due process can you realistically make when serving a patron... I have seen cases where the person is on camera claiming to be totally out of it, --- he can't remember a thing --- but he looked compliant and peaceful. Obviously a bartender shouldn't serve someone who's inebriated, but it's not like a light goes off the second you cross the barrier .

    In this case, the killer is the guy who voluntarily drank as an adult and became the victim as a result of his lack of accountability. I am all for changing the legal drinking age to 21, but as long as you are legal, YOU are liable in public and if you need to be babied, don't drink. Don't go to bars.

    An innocent victim suing someone is not the same as the killer suing someone. If you are old enough to drink, you are old enough to be held accountable. Don't make it more complicated than it needs to be so you can soothe a victim mentality that is not good for you or society. If you don't get that, you're part of the problem.

    Good to know your brilliance is so in tune with this situation that you think we should raise the drinking age to 21. Why hasn't anyone else thought of this?

    If a man walked into a gun shop and told the owner he wanted a gun he could "kill himself with" jokingly and the gun shop owner still sells him the gun the gun store owner is liable. That's the law just like a bar owner. Blame the law.

    I saw that interview. He looked like he always does. Maybe he is always on pain meds.

    Of course everyone is thinking pain meds but police are already saying he didn't seem impaired. He was driving a Genesis SUV, Genesis was the sponsor and I thinking pimping the SUV which was just released

    Nothing wrong with driving nice cars. That's the spoils of being rich.

    However, going downhill super fast on a street that's 45 MPH speed limit .
    well, not usually a good idea.

    The Genesis GV80 is a brand new model. It will be interesting if Hyundai investigate the performance of the vehicle in the wreck.

    I have found from my own experience, even if you think about it before hand, if you bend down to pick up something off the floorboard your car is going to swerve. Could have been just that.

    There were middle row and side airbags that deployed
