    Foundation’s lawyer suspected ‘something fishy’ when Texas Attorney General Ken Paxton intervened in case

    Chester, with the prominent law firm McGinnis Lochridge, said he’s been witnessing it firsthand in a tangled legal battle against Nate Paul, an investor who for years has been a figure of intrigue in Austin real estate circles and in 2019 became the subject of a federal investigation that included raids of his home and headquarters in Austin.

    Chester’s 2-year-old case involves the Roy F. and Joann Cole Mitte Foundation, an Austin-based nonprofit that is a limited partner in two entities controlled by Paul’s company, World Class Property Co.

    The Mitte Foundation, with Chester as its attorney, sued the two entities in late 2018, alleging it had been kept in the dark regarding financial information and seeking access to books and records.

    Paxton’s office intervened in the case this summer.

    Chester contends the attorney general’s office exerted undue pressure to push for a settlement financially advantageous to Paul — or “pennies on the dollar” compared with what the foundation was owed under a previous $10.5 million settlement reached in 2019.

    “We suspected all along that something fishy was behind the AG’s intervention in our case,” Chester said. “There is no legitimate reason why they would be helping Mr. Paul’s companies at the expense of a charity.”

    The American-Statesman revealed on Saturday that seven high-ranking officials in the Texas attorney general’s office filed a criminal complaint against agency chief Ken Paxton, asking federal law enforcement authorities to investigate allegations of improper influence, abuse of office, bribery and other potential crimes.

    In court documents and in an interview with the Statesman, Chester said Paul didn’t pay the $10.5 million settlement.

    And as things continued to “go south” for Paul, Chester said Paxton started taking an interest in the legal fight.

    Any time a charity is involved in litigation, the charitable trust division of the attorney general’s office must be notified because it has a right to intervene on behalf of the public interest in the charity.

    But the only reason the attorney general should get involved in such cases “is to help the charity — not help the criminal guy against the charity,” Chester said. “And that’s what happened here, and that’s what’s made it so unusual.”

    Michael Wynne, an attorney for Paul, told the Statesman that the foundation “refused to engage in any meaningful resolution” to the litigation, however, and also “colluded” with a court-appointed receiver in the case, squandering “over a million dollars in legal fees to line their lawyers’ pockets.”

    Those are the among the reasons Paul brought the case to the attention of the attorney general’s charitable trust division, he said, disputing a contention by Chester that Chester’s office did so when the lawsuit was first filed — as it was required to do by law.

    Wynne also said he is unaware of anyone from the attorney general’s office attempting to pressure Mitte to accept a settlement.

    “We were obviously not privy to any of those conversations and have no basis to comment on them,” he said.

    A rapid industry rise

    Paul, 33, has had a meteoric rise in the real estate industry, growing World Class into one of the nation’s largest privately owned real estate companies after founding it in 2007. More recently, however, his success has been marred by a spate of bankruptcies, legal skirmishes, loan defaults and foreclosure notices — as well as the federal investigation that led to searches of some of his properties in August 2019.

    The U.S. attorney’s office and other authorities have declined to comment on the raids, and no charges have been filed.

    But Paxton mounted an investigation into allegations made by Paul that federal agents with the FBI and U.S. Department of Treasury acted unlawfully during the 2019 raids. Paxton tapped an outside attorney, Houston lawyer Brandon Cammack, to conduct that probe.

    Seven senior Paxton aides — including his first assistant, who recently resigned — subsequently filed a criminal complaint against the attorney general that they say stems from his dealings with Paul, who donated $25,000 to Paxton’s reelection campaign in 2018. They’ve asked federal agents to investigate their boss for potential crimes that include bribery, abuse of office and improper influence.

    Cammack’s appointment was among the actions that prompted the complaint. Paxton’s intervention in the Mitte case also has sparked controversy.

    A senior official in the attorney general’s office recently voiced concerns to the American-Statesman about Paxton’s involvement in the Mitte lawsuit, saying attorneys in the agency’s charitable trust division were instructed by Paxton to weigh in, even though Paxton doesn’t typically take such a hands-on approach.

    “I saw just no interest why our office should get involved in this thing,” the official said. “Legally, and just the optics of doing something for a guy who is under FBI investigation — I am like, ‘This is reckless.’”

    Documents obtained by the Statesman indicate Paul prodded some staffers of the attorney general’s office to discuss with him their handing of the Mitte case and what Paul alleged to be improprieties by the foundation.

    Chester said his firm notified Paxton’s office about the lawsuit as required when it was filed, but was told the agency’s involvement wasn’t needed.

    “A junior attorney called me, asked me a few questions and said, ‘You’re fine, we don’t need to intervene,’” Chester recalled.

    That was the end of it, he thought.

    ‘Strong-arming us to settle’

    But subsequently, Paul suffered a series of setbacks in the case. In addition, the court-appointed receiver started making plans to sell the 1st and Trinity property.

    “The next thing you know, (the attorney general’s office) intervened,” Chester said. “At that point, we knew there was some connection between Nate and the attorney general’s office.”

    “We quickly started getting pressure to settle the case,” Chester said, and “for much less” than the 2019 agreement of $10.5 million.

    “They were strong-arming us to settle,” Chester said. “It was very uncomfortable and very threatening. Multiple people told me the pressure was coming straight from Paxton.”

    A call left Wednesday with the attorney general’s press office was not returned, and Godbey did not respond to an email for comment.

    The Statesman reached out to Mateer through the First Liberty Institute, where he formerly worked and has now rejoined after his recent resignation from the attorney general’s office. The Institute declined to provide contact information for Mateer.

    The Oct. 1 letter alleging criminal conduct by Paxton that was signed by seven of his staffers said each “has knowledge of facts relevant to these potential offenses and has provided statements concerning those facts to the appropriate law enforcement.”

    The allegations include abuse of office, bribery and other possible wrongdoing.

    Paxton issued a statement Saturday saying the seven employees have made “false claims” against him. On Monday, he pointed the finger back at the staffers, albeit without naming any of them, saying they “impeded” his investigation into the 2019 search of Paul’s properties by federal agents.

    “Because employees from my office impeded the investigation and because I knew Nate Paul I ultimately decided to hire an outside independent prosecutor to make his own independent determination,” Paxton’s statement said. “Despite the effort by rogue employees and their false allegations I will continue to seek justice in Texas and will not be resigning.”

    Paxton has not said how employees interfered with the investigation. And the seven employees have not publicly provided specifics underlying their allegations of bribery, improper influence and other potential crimes.

    In the wake of last year’s FBI raids, multiple Paul-controlled real estate entities have filed bankruptcy.

    Paul has filed at least 22 bankruptcies since November — including filings in August on both of the entities involved in the Mitte litigation. A judge subsequently threw those two out because the foundation and the court-appointed receiver argued successfully that Paul’s companies lacked authority to file them.

    The serious criminal allegations that Texas Attorney General Ken Paxton is facing could be tied to some degree to an episode of infidelity involving a woman who's been employed by one of his wife's colleagues in Legislature's upper chamber.

    Paxton - a conservative Republican who's been accused of bribery and other crimes by his top assistants - had apologized in the past few months to some of the same senior staff members who've turned against him for personal indiscretions of which GOP State Senator Angela Paxton of McKinney apparently is aware.

    Paxton's former top assistant and six other high-ranking officials have accused the AG of appointing a special prosecutor to investigate a campaign donor's enemies in the business world. The contributor in question is Nate Paul - an Austin developer who's contributed in the past two years to U.S. Senator John Cornyn and several other statewide GOP leaders including Lieutenant Governor Dan Patrick.

    Travis County District Attorney Margaret Moore revealed on Friday that Paxton had attempted to solicit her office's help in the probe into Paul's rivals with a formal request for an investigation at the local level.

    Moore fired off a letter to the attorney general today that sought to repudiate his assertion that he'd initiated the probe after Moore had referred the case to the agency that he leads. Moore said she'd simply forwarded Paul's complaint to the AG's office after determining that the DA's office was not the appropriate venue for such an inquiry that she'd never initiated.

    While Paxton has been under indictment for state securities fraud for the past five years, the latest tribulations in the legal arena are far more serious than the 2015 allegations that featured a former Texas House Republican colleague as a chief accuser. But the new Paxton saga has been compounded by gossip about the affair that hasn't been substantiated beyond the confession and apology to the aides who are attempting to destroy his career now.

    The name of the apparent mistress will become public at some point amid speculation on a possible link to Paul. But Capitol Inside has chosen not to identify the woman at the center of the sideshow drama as someone who hasn't been accused of any criminal wrongdoing up to now.

    But the romantic relationship is common knowledge inside the state Capitol beltway in Austin where the state lawyer's spouse will be dragged into the story even though she's simply been an apparent victim of the adultery that her husband acknowledged privately to people he thought he could trust. None of the deputy attorneys general who've provided evidence to law enforcement authorities to support their claims have apparently mentioned the ostensible affair in a public fashion.

    The sidebar drama is all the more scandalous in light of Paxton's reputation as a staunch Christian who's attended the megachurch Prestonwood Baptist in the suburbs north of Dallas where his wife is in her first term in the same Senate district that her husband represented before a promotion to AG in 2014.

    Paxton and Patrick have been regarded as the two most conservative statewide leaders in the state since winning their current terms six years ago before successful re-election races in 2018. Paul donated $25,000 to Paxton in 2018 when he also gave Patrick $10,000 two years ago when he contributed $5,000 to Comptroller Glenn Hegar, $2,500 to Land Commissioner George P. Bush and $1,000 apiece to Agriculture Commissioner Sid Miller and Texas Railroad Commissioner Christi Craddick.

    U.S. Rep. Michael McCaul of Austin and Cornyn both received $2,800 from Paul last year - the maximum amount from individual contributors in federal races.

    Judge rebukes Nate Paul and lawyer, tosses suit against Austin nonprofit
    In a legal defeat for Austin real estate investor Nate Paul, a state district judge has thrown out a lawsuit two Paul-controlled entities filed against an Austin nonprofit – and sanctioned both Paul and his attorney in the process, saying the suit was filed with the intent to harass the defendants.

    State District Judge Jan Soifer dismissed Paul’s lawsuit, ruling against his attorney Michael Wynne and two Delaware-based limited liability corporations that Paul created in April and that he owns and controls. Wynne also represents Paul in a criminal matter involving an FBI raid on Paul’s home and offices last year, in which no charges or indictments have been filed.

    In the case Soifer dismissed, the Paul-controlled entities claim to own majority interests in two real estate partnerships in which the Roy F. and Joann Cole Mitte Foundation own minority interests.

    In her ruling, Soifer said Paul’s lawsuit was baseless and filed maliciously, meant only to harass, delay litigation and add to fees in the main litigation and arbitration case that is ongoing. She awarded sanctions and attorneys’ fees totaling nearly $232,000 – and potentially more – to the Austin-based Mitte Foundation and other parties.

    Texas Attorney General Ken Paxton’s office intervened in the main Mitte Foundation case this summer, only recently dropping its involvement amid allegations of impropriety, bribery and abuse of office stemming from Paxton’s ties to Paul.

    All seven of Texas Attorney General Ken Paxton's whistleblowers have resigned, been fired or put on leave
    The last of the seven whistleblowers, Ryan Bangert, said he resigned Wednesday. Two others had already resigned, two more were fired last week, and two were put on leave earlier this month.

    One thing the Trump regime brought was how brazen these folks felt like they could be with their crimes. Its ok to be a criminal, its ok to be racist, its ok to be sexist.

    Maybe we would be better off being two countries. It'd be like the EU. And then Russia.

    My friend knows many of the people who are accusing Paxton. He said they are all die hard Republicans and all probably voted for Trump. This isn't political at all.

    My friend also voted for Trump.
