Medical Debt / Insurance Specialists here please

    Had a baby in August of 2018.

    My wife is on her own insurance.

    I am on my own insurance.

    Decided to add baby onto my insurance.

    Hospital bills my wife's insurance for the birth, denied, then finally gets it right and bills my insurance in March 2019.

    My insurance denies the claim and says I am not responsible because claim was not filed timely. They instruct me not to pay it.

    Hospital is now sending it too collections on me.

    I told the debt collector I would be happy to pay my portion, whatever the co-insurance / deductible amount was, but would not be paying the full amount, provided this was taken as full and final settlement. They said they would take my portion, and put the rest in dispute. I told them no, I would only make the payment if it settled the entire debt.

    How do I resolve this without lawyering up.

    At face value, it appears the hospital is at fault. Why did they bill your wife's insurance and not yours?

    Contact your insurance - they may have a law office that handles this so that you do not pay anything.

    I know if my insurance or EOB says I don't owe it..an I get another bill then I file it with ELAP which is a part of my insurance. They lawyer-up and send cease and desist orders to the Dr / hospital. I've needed to do this 3 or 4 times and it works well. I never get another bill afterwards.

    because in Texas the newborn is automatically added to the mother’s insurance at birth.

    unless you can prove that you provided them the accurate insurance information then timely filing doesn’t apply here

    You can also check to see if your company has insurance support through their company life insurance program. A lot of those companies offer things like EAP and insurance billing support as value adds
