    Kazaa Owner Gets OK to Sue Movie, Record Companie

    LOS ANGELES (Reuters) - A U.S. federal court has cleared the way for Kazaa file-sharing software owner Sharman Networks to sue the entertainment industry for copyright infringement, Sharman said on Friday.



    Sharman, targeted by studios and record companies because its software is used to trade music and video files, has sought to turn the tables on the industry, accusing it of misusing Kazaa software to invade users' privacy and send corrupt files and threatening messages.


    Studios and record companies had asked the court to throw out Sharman's countersuit, but U.S. District Judge Stephen Wilson in Los Angeles declined to do so.


    Sharman, headquartered on the island nation of Vanuatu in the South Pacific, said it would pursue the case.

    Here's what I don't get, why aren't there more counter suits agains RIAA in from people that are being sued without ever downloading because road runner actually switches IP's randomly and a lady that uses mac (not kazaa compatible) got sued. There should be a couple of more cases like this and I think people that are falsely accused should counter sue.

    There's also a precedence of it being OK for one friend make a copy of a tape and giving it to another friend. I understand that Kazaa is a different media but I can definitely see the correlation.

    I download music. But i still buy cd's that i hear that i like. Im not sure what could ever curve my addiction of buying cd's.

    I don't even download much music any more. After I collected all the songs I wanted, my downloading has ended. Most new music is crap now, so there's not much music that's good enough for me to download any more.

    I'm in the same boat. I download music to check out other songs on an album before I purchase it. I usually buy around 5-10 cds a month...and the addiction cannot be kicked.

    5500 cds and counting, but the space to store them is disappearing.

    Are you sure that rr switches IP addresses randomly? I don't think so. When I do IPCONFIG I still have the same IP.

    Mine has switched only once in 2 years with RR. You have to pay extra for a static ip.

    Here's what the record industry can do to help itself and co-exist with File Sharing:

    LOWER THE PRICES!!

    DVD's totally get it! If it's old, sell it cheaper. Every time I look for something not in the top 40, it's 20 bucks!! Even the pop cds are going for almost 18 a pop! If CD's got (BACK) into that 8 - 14 dollar range, the sales would be rediculous!

    Exactly. I plateaued well over a year ago. I figure they're not going to mind my occasional download every couple of weeks.

    Sorry to double post, but I absolutely agree. I only buy CD's from used CD stores anymore, because it's not worth paying $20, or even $16/18. All the CD's I've purchased new were from back in the day when you could still get a decent CD for $10/12.

    Not anymore.

    I pretty much have all the music I need, so I haven't been downloading much anymore. Occasionally I might hear I song I would want. But not very often anymore.

    For those who still are downloading, what do you use? Seems like some of the networks are down, now. Tried the bit torrant thing, but I still find it hard to find what I am looking for.

    What's funny is that I'll be buying Outkast's new album, as well as Incubus, but for some of the downtempo stuff that I like, file sharing is invaluable, because it's so hard to find/try out different stuff otherwise.

    Yes, it does switch, how often I don't know but in the case of this woman, hers did when she got sued even though she uses a mac. Still, I think a major court case would be the ruling of copied tapes allowed, like I said I think file sharing should fall somewhere along those provisions.
