    Now THIS is a fascinating case, with plural and conflicting values. The city wants to prevent the homeless from congregating in a city park (they want to "defeat the homeless" in the mayor's unfortunate turn of phrase), and the non-profit food pantry wants to feed the homeless in order to

    "communicate its message 'that . . . society can end hunger and poverty if we redirect our collective resources from the military and war and that food is a human right, not a privilege, which society has a responsibility to provide for all.’"
    The city passed an ordinance that in effect prevented the food pantry from operating in the city park.

    Now the 11th Circuit has ruled in favor of the NGO, Food Not Bombs, on First Amendment free speech grounds. Absolutely fascinating.

    It's not saying feeding the homeless is a constitutional right, it's saying an act that also communicates a message is protected speech.

    I am not sure I agree with that, but that is a difference than your title.

    yep. I didn't pick the title, but protected speech is a constitutional right, no? granted a provocative title does get people to click on the article

    Very misleading title. The question is whether or not their claim that what they are doing is speech. I am skeptical of that claim, but apparently the judge agreed with it.

    At the same time, I am not sure why the city would not work with the organization to find a mutual solution. Seems foolish to fight this in this way. If you wanted to keep the homeless out of a particular park then find another way to assist with distribution of the food.

    Donating money for a political cause is speech. Food can be bartered like money, therefore it's speech.

    Sex can also be bartered like money, therefore...
