On Thursday I was riding to dinner with my fiance and my new born, when another car coming in the opposite direction tried to turn onto a side street on our side of the road essentially causing a head on collision with us. Both of us were driving ~40 mph.

Alot of people keep asking me about lawyers, settlements, etc. and I wanted to see if anyone was a specialist in this area, and what the best course of action I should take is.

    Here are the facts:
    - I was driving my fiancee's car, and we each have separate full coverage policies on our own cars.
    - I shatterred by leg in 2 spots, and also shattered my ankle.
    - I have jet black bruises on ~20% of my body. My entire left forearm and basically 2 inches on either side of anywhere a seatbelt made contact with my chest / stomach.
-I have numerous cuts, scratches, gouges on my knees, legs, arms, hands and face.
    - I was in the Hospital 3 days and had emergency surgery on my leg.
-My fiancee had similar bruises, and a cat scan, but was released the same day as the accident.
    -Baby had no injuries.
-The other driver was 100% at fault and was ticketed by the police.
-The other driver had what appears to be minimum liability coverage.
    - I will likely not be able to go to work for weeks, but can skate by working from home, but not at full capacity.
    - I likely won't be able to walk for six weeks or so, although that is a total guess.
-My personal health insurance had already met its out of pocket max prior to the accident, so I was not financially impacted by the medical bills.

The firm that represents my health insurer to recover costs from the other driver's insurance company asked me if I had a lawyer, and had thought about a settlement, but wouldn't advise me on what to do.

I am unclear how any of this works and would appreciate any informed advice.

Unfortunately I do not, but I'm glad to hear you and your fiancé and baby are ok. That's a terrible event. I hope you get what you deserve. I mean that in the best way possible. I hope you can get max punitive damages off that *******.

Request your doctor to complete FMLA paperwork for your work -- have a consult with a good attorney to see if it is worth going after the other driver.

I'm not a lawyer, but I did sleep at a Holiday Inn Express last night.

    I require a $5,000 retainer.

Sorry to hear all that happen. Glad the baby didn't have any injuries.

I would think you need a goo attorney. Your insurance's firm may only be trying to get back what they paid out. Not sure what the other driver's insurance maximum payouts are, but it'd be a good thing to know (assuming your medical/work stoppage/etc. approaches that number).

    In Short, call this guy[IMG]

Using that guy might not be bad advice. My parents did 15-20 years ago and his team took care of everything (medical, therapy sessions, etc), not just the settlement.
