Anybody ever have to deal with evicting a tenant from a garage apartment?

    I purchased a house recently that has a large detached garage with a female tenant living above it. When I first inspected the property the young woman was very nice and informative about issues with the property, she had apparently lived there for some time and only pays $450 a month. When I explained that I was interested in purchasing the property and fixing up the garage apartment she was very happy, since the previous owner an 80 year old lady had never done anything to the place since the mid-80s.


    Fast forward a little over a month and the repairs and upgrades to the garage and apartment area are completed and looking Great! I must say the young lady could be a very talented interior designer, She was able to locate and get great pricing on Travertine tile, light fixtures and some other really nice upgrades that I know will allow me to rent out that Apartment for close to $1800 a month!!.She has not ever paid me the $450 she was paying the old lady previously in the past 7 weeks and I thought since she was so helpful with the remodel I wouldn’t push it. I tried to talk to her for the past week to discuss rent with the end of month fast approaching I really need to see if she is willing to pay the increase or start to find another place to live. So far she is always just in a rush to leave or keeps the door locked and doesn’t answer my calls.


    A couple of nights ago I waited on the back porch and approached her as she came up the drive way. She of course explained she was very busy and we will have to catch up some other time. I hurriedly brought up the issue of the rent, after which she told me that she doesn’t pay rent. I asked about the $450 monthly rent she paid the old lady and she went into a story about how that wasn’t rent, it was her just helping out a poor old woman to get by and since the old woman was gone and I’m young enough to fend for myself she won’t have to help me out with $450 a month as that would be silly. I stuttered shocked by her response as she tried to move forward to the garage and I stammered out but the lease, She laughed as she unlocked the door and says that she doesn’t have a lease and has been living in the garage for 18 years and has no intention of leaving this nice area of town anytime soon. Especially after how beautiful it has become then slammed the door.


    How do I get this person out of my garage apartment? I need the rent to help cover the upgrades and mortgage on the house.

    I guess call the cops and accuse her of trespassing, since there is no lease agreement proving she lives there?

    Have to go through the administrative eviction procedures with or without a lease is my guess. Once you have all your CYA documents in order...then call cops if she doesn't leave.

    Sounds like this guy's mom? If so, you're screwed, but at least she's paying you some money, and not eating your food.

    She's not paying him money though. She laughed at the thought of giving him $450 a month.

    I think you're going to have to go through the eviction process. Get the paperwork started, so that when you have to call the cops, you have everything in order. Because she doesn't have a lease, there is no way she'll be allowed to stay.....especially if this is in Texas.

    This would be a great case for Judge Judy. She would get laughed at by the judge. She sounds like a squatter.

    Who the hell does she think she is? No rent. Life is not a free ride. I'm assuming you foot the bill on all the upgrades. If not, then whatever she paid could be counted as rent for a bit imo.
