The revelation came a day after Bryant's lead defense lawyer, Pamela Mackey, caused an uproar at a court hearing by asking whether the woman's vaginal tearing was the result of "sex with three different men in three days." Retired Eagle County District Court Judge William Jones said Mackey asked the question because she has physical evidence suggesting the tearing could have happened during an earlier sexual encounter. "There was more than one man's semen found in her panties," Jones said. "That's what's behind all of this." Jones said he learned of this from Mackey's co-counsel, Hal Haddon. "I have known him for 40 years," Jones said. "He was doing some work for me and he mentioned it to me. It will come out in due course." He does not account for Mackey's suggestion that the woman had sex with a third man. Citing the gag order that Judge Frederick Gannett imposed on the case, a spokeswoman for District Attorney Mark Hurlbert declined to comment. Bryant's defenders also declined to discuss the case. Veteran Denver criminal defense attorney Jeralyn Merritt said she's convinced Mackey has something up her sleeve. "By her asking that question, it's clear they have evidence about the accuser," she said. "Pamela Mackey would not have brought this up out of thin air." Mackey, a lawyer known as a pit bull in pearls, dropped her bomb after Eagle County Sheriff's Detective Doug Winters recounted in graphic detail the alleged victim's version of what happened on June 30 at the posh hotel near Vail, Colo. The 19-year-old woman told cops she and Bryant kissed. But when she tried to leave, Bryant bent her over a chair and raped her, Winters said. The accuser's blood was found on Bryant's clothes, Winters said. But Mackey's surprise question brought the proceeding to an abrupt halt. The hearing resumes on Wednesday. Crossed a legal line? Former Denver District Attorney Norm Early said Mackey "blatantly smeared" Bryant's accuser and possibly violated Colorado's Rape Shield law, which bars lawyers from delving into the sex lives of assault victims. "I don't care what evidence they could have, three nights of consensual sex with three different partners would not lead to a vaginal tear," Early said. Karen Steinhauser, another former Denver prosecutor and an expert on sex assault cases, disagreed. She said vaginal tearing also occurs during consensual sex and that Mackey's question was "proper." "There is an exception under the Rape Shield that allows her to ask about the injuries if there is evidence they could have been caused before," she said. Mackey is no stranger to high-profile cases. Among others, Mackey got a domestic violence charge against Colorado Avalanche goalie Patrick Roy dropped. She also avoided jail time for Jeane Newmaker, who smothered her 10-year-old adopted daughter in a highly publicized "rebirthing" case three years ago. Bruise was no seen by detective in interview. The vaginal trauma needs magnification and dye to be visible. It's all about evidence, the prosecution looks weak so far for me.
TRUTH is NOBODY but KOBE and the ACUSER really know what happened. I hate that people all over American and probably the world think that they really know what happened based on little evidence they read about or see on t.v. Either way, Kobe is a dumbass for putting himself in that situation. I have two questions: 1. Why wasn't his wife with him on the trip? I mean it was close to the 4th of July weekend and he spends most of the NBA season away from her, if they socalled "LOVE" each other so much they would be together, especially on a trip where they can be alone together. 2. Why would Kobe cheat on his wife when he supposedly went through all this drama with his parents about marrying this girl. His parents didn't attend the wedding and didn't speak to him for months after the wedding b/c they were against it. I saw Kobe on TV crying about how it hurt him bad that they accept her and how he loved her so much. Why would you go through all that with your parents and go and do something sooooooooo stupid with another girl which shows that he is not happily married and give his parents reason to say we told you so.

i think that the defense is insinuating that if the girl had sex with several men during that time, what was once considered vaginal injuries from one encounter, may just be normal after three sexual episodes. in addition, if there is other semen in her panties, it means the other guy did not use a condom, thus, this means that she was either raped again or she has consensual sex without condoms. i guarantee that she must be on the pill, and the prosecution will argue that she sleeps around, before and after the encounter, showing that not only is she a slut, but she was not emotionally damaged enough to stray from sex after being raped. these are just assumptions of course, but from what the defense has said, this logic should follow afterwards.
Say the defense finds (pays) a couple guys to testify they had sex with the accuser before/after the alleged rape.....would it then be necessary for the accuser to testify herself in order to refute these stories? subjecting her to all kinds of cross-examination by the defense team? All warfare is based on deception.
She doesn't have to testify, nor does Kobe. Not doing so may or may not hurt their case. If she doesn't in light of such evidence (if it exists), then she may be risking her case. Then again, she's continuously getting her friends to come out and present stories which don't mesh with what she initially told the detectives. I fully expect her to get on the stand and do the defense's work for them. If there is other DNA present in her undergarments, it can be matched to someone other than Kobe. If Mackey really has other DNA evidence, she's going to blind them with science, and she may even have the person(s) whose DNA is also present. No need to "pay" anyone. With such evidence, it's the accuser's side who would have to deceive the jury into a different interpretation.
