I see a correlation in the arguments for and against concealed handgun licenses where one side says 'all guns are bad and would only make the situation worse by antagonizing a gunman and/or potentially hitting an innocent' whereas the CHL supporters would say 'BS, if someone else was armed and properly trained (which is required for a CHL) they could have taken out the bad guy and no one else would have gotten killed.' Does that make sense? I don't know EBM's mind, of course, but perhaps he was thinking along the lines of "Okay, I moved and this guy is still coming at me verbally and now physically. Time to act and act quickly." That's how I see the scenario.

He was simply exercising his rights to free speech and responding to what DeeJay was saying in kind.
He has a right to defend himself when attacked. I think he could have been wiser with the words he used preceding the attack to help diffuse the situation. It doesn't always pay to be passive. Some situations don't warrant it. But in this case, I think it would have been the more reasonable approach. Just my opinion. I could be wrong ... perhaps "Beatlejuice" was a lunatic who was going to pounce on him regardless. I don't really see it, but then I'm not a mind reader. It is possible.

There's three possible ways to look at it: (1) By just apologizing for the misunderstanding and not responding, the older man is showing himself to be weak. Now Beatlejuice will feel more bold and that will increase the chances of an attack. (2) "Ima put my foot up yo ass" was tough guy posturing from Beatlejuice. He was saying it because he was pissed off and felt slighted. That and he's evidently not very smart. In that situation, responses such as "Try it and I'll put my foot up your ass" exacerbates the problem. Now the other guy is even more pissed off. Chances of him snapping and making good on his threat goes up. (3) Beatlejuice was looking for a fight regardless of the older man's reactions, and the punch was basically inevitable. Unfortunately, it would be pointless for me to continue and answer your question, because we don't see eye to eye on which of the above accurately describes the situation.
I'm going to go with durvasa on this one. This isn't a bunch of kids in the schoolyard shoving each other. Normal people (and in fact I guess this guy was some PTSD/schizophrenic or something) don't act the way the gentleman did. They should (and, I think, would) both be prosecuted by any DA in the country for assault, disorderly conduct, etc. You can't simply instigate a fight and then toss the second punch and get off scott free - hell even in the NHL you get penalized for that. Please don't say freedom of expression and free speech.. free speech does not apply when inciting violence... And it disturbes me that we are holding a mentally ill person to the same standard as a normal person...
Really you think they both should get charged with assault? I agree with you about disorderly conduct, but the old dude has every right to defend himself after being assaulted. If DeeJay would have pulled a knife on old dude and old dude kicked his ass would it still be assault on his part? I guess my point is you always have a right to defend yourself, and this is a clear case of self defense. Self-defense is the right to use reasonable force to protect oneself or members of the family from bodily harm, or to a lesser extent, one's property, from the attack of an aggressor, if the defender has reason to believe he/she/they is/are in danger. the guy wasa clearly defending himself from bodily harm.. he also was not excessive in his defense.. IMHO
