A police dispatcher's word is not legal advise or gospel. How many times has this been discussed? You can not be in trouble for disregarding a dispatcher's instructions. Listening to a dispatcher could even get you killed depending on the situation. I decide what I do. I'm responsible for my own actions/safety. A dispatched has to say the most PC thing because of vicarious liability. Do you think a dispatcher is going to tell you to run into a burning building to grab someone? Do you think they will EVER tell you to use deadly force if someone has broken into your home? Everyone needs someone to put the liability on these days.
Right, but from the call we know GZ got out of his car and follow a running person. That is not the issue that he disregarded the suggestion, it is that he pursued TM. Now the defense needs to prove that TM hid and attacked GZ rather than TM approaching GZ when they were apparently eyeing each other.
