I use BitTorrent, it's not fast as other p2p network, but no one can catch you, and you can find download links easily from place like suprnova.org.

Court Throws Out Net Music Legal Tactics

WASHINGTON (Reuters) - In a surprise setback for the recording industry, a U.S. appeals court ruled on Friday that record labels must abandon their favorite method to track down those who illegally copy music online.

Recording companies must file a formal lawsuit if they want Internet providers to turn over the names of customers who may be copying music illegally, the court said, adding the industry's legal basis for inundating Internet providers with thousands of subpoenas "borders upon the silly."

The decision complicates the beleaguered industry's efforts to stamp out online song copying over "peer to peer" networks such as Kazaa, a practice the industry believes has contributed to plummeting CD sales.

Earlier on Friday the Dutch supreme court ruled Kazaa can not be held liable for the activity of its users, underlining the industry's inability to shut down the online networks over which millions of songs are copied daily.

The Recording Industry Association of America began filing lawsuits against individual users this fall, and so far has reached at least 220 out-of-court settlements, usually for $5,000 or less.

The trade group invoked a 1998 digital-copyright law to force Internet providers such as Verizon Communications (VZ) to turn over suspects' names, an approach upheld by a lower court earlier this year.

But the law does not apply to peer-to-peer networks, where infringing material is stored on individual hard drives rather than public Web sites, the appeals court said.

"Verizon can not remove or disable one user's access to infringing material resident on another user's computer because Verizon does not control the content on its subscribers' computers," Chief Judge Douglas Ginsburg wrote.

RIAA President Cary Sherman said the trade group will continue to pursue suspected copyright violators through so-called "John Doe" lawsuits, a more cumbersome legal process that gives the accused the right to contest the charges before his identity is revealed.

"The decision's a disappointment ... but that just means that settlement figures may have to be higher to pay the additional legal expenses" involved in filing John Doe suits, Sherman said.

Sherman declined to say whether the RIAA would appeal the decision.

A Verizon official said the John Doe lawsuits would discourage frivolous subpoenas and protect customer privacy and due-process rights.

"Verizon is definitely interested in working with all of the copyright community in finding ways to stop piracy, but we have to do it in a way that supports the balance between users' rights and the rights of the copyright holder," said Sarah Deutsch, a Verizon vice president and associate general counsel.

Several legal experts said the decision would not affect ongoing lawsuits or cases that have been settled, but the industry's anti-piracy campaign will get more expensive and it will have to research its cases more thoroughly.

"In some ways it's kind of a mixed blessing for the recording industry, because they're not going to end up having the grandma in Massachusetts who is accused of having Linkin Park and hip-hop music on her computer," said Gigi Sohn, president of Public Knowledge, a Washington think tank.

One peer-to-peer operator said the industry would eventually have to sit down at the bargaining table.

"As usual, the lawyers are the winners. Sooner or later somebody (in the recording industry) is going to have some common sense and say, 'Why are we spending all this money and getting nowhere?"' said Wayne Rosso, chief executive of Optisoft SL, a Spanish software company that has developed the Blubster and Piolet peer-to-peer networks.

RIAA members include Vivendi Universal's (V) Universal Music Group; Time Warner Inc.'s (TWX) Warner Music; EMI Group Plc (EMI); Sony Corp's (6758) Sony Music; and Bertelsmann AG's (BERT) BMG.

I've never used it. My linux/mac lovin' officemate told me about it. I hope to give it a shot. Apparently there was some information about it on slashdot and someone said that they just did a general search for mp3 and came up with nothing. Obviously there needs to be a fair amount of people on the "network" in order for it to work, but the theory behind the invisibility of the users was pretty interesting.

Now that I've gotten a chance to use the program a bit...it's OK. It's no original Napster, but when they release something other than an alpha/beta version, it might turn out to be better. Apparently the two sites they have to connect to as an initial startup connection were bombarded as soon as this page was released and they were removed due to a high amount of traffic. My officemate has a linux system that is hangout off of the internet somewhere and he set up the client there and I set it up on my work PC and we exchanged a couple of files. Very rudimentary, but workable. Still needs a lot of doctoring though.

I was just looking at my Kazaa Lite options and there's a whole set of privacy preferences aimed specifically towards blocking RIAA from seeing your files. It actually blocks RIAA's IP addresses from your account, disables specific ports that they must use, and keeps anyone from being able to see all of your files.

I guess that's what you get when "pirating" software gets pirated.

Umm yeah... Nah I DL the 24, Simple Life, Quantum Leap, Family Guy, and Will and Grace episodes. Plus they have tons of movies.
