I would be very surprised if either one were taken alive. It's more likely, in my opinion, that they are discovered in pieces after being blown up by a drone, but I have no objection to a trial in New York if they're captured.
If bin Laden and al-Zawahiri were put into a "normal" American prison, I would certainly agree, but they won't be in the unlikely event that they're captured. They would be in solitary confinement and under 24 hour watch, at least in my opinion. I wouldn't shed a tear if either one got bumped off by a fellow prisoner, though. My main concern would be that they would no longer be available to sing a tune under interrogation. I still vividly recall watching as Jack Ruby shot Oswald, live on TV. My cousin and I jumped up and cheered. Cheered like crazy lunatics. Only much later did we realize what a disaster it was.
I strongly doubt that will happen and if anything the October surprise is leaks about how close we are to capturing or killing Bin Ladin. Also depending upon how close it is to election day I'm not sure that killing Bin Ladin might make that much of a difference. It might swing a few seats and while this election has much to do regarding the view of the President it also has a lot to do with people's opinions of incumbents in Congress.
There is no good that can come out of capturing osama. If he gets killed he becomes a martyr for his people. If he was willing to give up a world of wealth to go live in caves why would he suddenly start squealing to the feds? If he gets captured, they will try kidnapping etc to make trades to get him out and could you imagine how much money we would waste staging a trial. Getting osoma shouldn't be the goal, but to destroy his idea.

That's no excuse IMO. Martyr or not, the principles of equity and justice require that you send this guy to a fair trial, and in a fair trial, it's difficult to see the outcome being anything other than a death sentence. In fact I would love to see him tried under his own Sharia law, given that it should result in the same sentence. It would really make a point of what a horrendous human being he is.
