What makes one murder so much worse than another? Intent? Method? Reason behind it? I'm just curious as to what makes ONE Murder so much more Heinous than another? Rocket River
My question is why is attemted murder less of a crime than murder? Someone shoots another person 6 times and they live by pure luck the shooter gets charged with attempted murder and usually a much lighter sentence. Someone punches someone in a fight they fall hit their head and die (this happened)-- possible murder 2 charge---- Doesn't make sense to me.
underoverup, I think murder requires a degree of planning and/or intent. What you describe with the punch would probably be manslaughter. That's according to what I've learned from TV.

There are lots of other examples I could use, but the guy did get charged with murder in that case. I think usually it would be manslaughter. As I understand it Murder 1 is premeditated, Murder 2 is a crime of passion type thing or no preplanning (guy disses the Rockets, and you shoot him). Btw- Who is this T.V. you speak of ??? Yeah, Harris probably got some sympathy from jurors who thought passion played a part. Mallard's included plenty of premeditation. After ramming the guy, she could have settled down and called the police and hospital. Instead, she tried to get away with it. And they showed her back at the same club the next week in a video. She also supposedly tampered with evidence. (Personally I think Harris should have gotten more.)

It's more than an accident. It became premeditation because the guy was still alive. If the guy died on impact, then I would agree with you. But he was alive and she basically murdered him by leaving him in her garage.
Is it just a rhetorical question or do you want the definitions according to Texas law? I could probably explain it more or less according to NY law. I believe there are some slight differences between the states.
