I believe that in all countries, you're at fault for following too closely and not being able to control your speed. You should not hit a car from behind. A car should not hit you by backing up, though, and then telling people you failed to stop yours. trueroxfan, you shouldn't do that on purpose, though. You should have a good reason to slam on your brakes, and then you're not at fault.
