Your friend should tell that judge that recent studies indicate that cell phone use while driving is more dangerous than DWI. Comparatively speaking, DWI really isn't that bad any more. Heck, just look at Christianity and witchcraft, both of which meant automatic death at one time or another. Now, nobody gives those two things a second thought. Just explain to the judge that it's the natural evolution of laws.
