    WTF??? that **** is hard to do even when you're sober. as a matter of fact, right now i still don't know what comes after W in a backwards alphabet.

    They are really cracking down on this. You guys absolutely have to stop drinking and driving. It is not fun, trust me, the biggest pain in the ass in the world. Even after 1 or 2 drinks, just don't do it guys it isn't worth it.

    Best of luck with that, Hayes. Having to go through something embarrassing and legally damaging is difficult and uncomfortable.

    I'm really curious about something. I so often see people saying not to take the breathalizer test because that can incriminate you. But, what if you ARE over the legal limit? Don't we all have a moral and ethical responsibility to accept punishment for crime if we do commit it?

    I just wonder because I don't attempt to get out of my tickets when I get them and I can't imagine I would try to get out of a DWI regardless of the consequenses. If I break the law, I break the law.

    So often in here, we demand that people be tough, suck it up, deal with it when you have problems, etc. Yet, in this instance, the general response seems to be: save your ass at all costs. Just seems a little hypocritical to me. All of you guys who are so willing to be tough on crime and have zero tolerance when someone else breaks the law, I'm assuming if you thought you might be drunk and were pulled over, you'd take the breath test and deal with the consequences, right?

    Ditto. It's absolutely nothing personal, but I have zero sympathy for those who drink and drive. It's literally gambling with other people's lives (not to mention your own), and having personally known victims of drunk drivers it especially 'hits home' with me.

    Good luck with your case, Hayes, but I would be lying if I said I hope you or anyone else who drinks and drives 'gets off easy'...

    so if you ever commit a crime, knowingly or unknowingly, accidently or purposely, you'd readily accept the charges w/o representation and will not protest the consequences?

    i'm not making excuses for the drunk drivers but if you can get off for your "crime", it only make sense to fight it as cheaply as possible.

    One more thing, the absolute worst thing about it? If it goes on your record it will show up on every sort of background check imaginable. Good luck getting a decent job with that on your record. All companies do background checks now.

    yep, not to mention your insurance skyrocketing.

    also, don't some companies also fire you if they find out you got one.

    Just part of human nature I guess. Everyone is hard core until it's your ass or someone close to you is in trouble. Then you're praying for the case to get thrown out on a technicality.

    DWI becomes a felony I believe on the 3rd offense and you can actually go to a State Jail for it. I hope you clear things up and definitely get a lawyer Hayes.

    If I was in the wrong and I had committed a crime, yes, I would absolutely accept the consequences. It doesn't mean I wouldn't seek leniency in punishment if possible or that I wouldn't hire an attorney to represent me, but I would absolutely own up to my guilt and accept responsibility for what I had done.

    There is a difference between accepting guilt and having representation to help you through the process and seek the best option for punishment. That, I'd do. But, I would not try to "get off" or plead innocent if I were guilty of the crime for which I was accused. That is not only irresponsible, to me, it is completely and utterly unethical.

    I'm utterly floored by the intellectual inconsistency I see on certain issues.

    I'm humored by the fact that we all seem to downgrade and criticize lawyers-- until we need them. THEN, all of a sudden, it's "You gotta get a lawyer" and "Pay them whatever they want", etc...

    Then I read threads where someone gets, like, an Ipod stolen and we're all screaming "That dude needs some jailtime" or "If I was on that jury I would sentence him to the max" or "He needs a conviction". Yet when we're talking about driving a 5,000lb piece of metal down the road impaired, it must just be the cops trying to reach their DWI "quota". Or its just the man trying to make a buck by hassling us with surcharges and increased insurance rates. Whatever.

    DWI is a very interesting topic because there is always that "There but for the grace of God go I" mentality. We have a hard time being hard asses and "judging" someone because many of us have been in that situation. It hits home. And it's subconsciously uncomfortable to, in essence, indict ourselves by doing anything other than blaming the cops, the legislature, society, MADD, etc...

    Some of you guys are idiots - I don't know how else to put it.

    1.) WTF are you people still drinking & driving? Are you brokeasses? Take a freaking cab.

    2.) WTF do you still take the field sobriety test? Is HPD putting a gun to your head and asking you to?

    How many times do I have to post that if you have had damn near anything more powerful than Scope in your mouth, YOU WILL FAIL THE FS TEST!

    Say no to everything and sleep it off in jail. Yeah you'll blow a few $K on one of my brethren, but YOU WILL DO THAT ANYWAY AND HURT YOURSELF MORE if you take the FS test.

    Wow. Enjoy probation & your impending involuntary separation from alcohol consumption.

    Say you have been drinking and you will most likely blow more than a .08 but you are not slurring or acting the fool. I understand you are to pass on the FS test and go to jail.

    What do they arrest you on? How serious is the charge? Criminal? Misdemeanor? Is it jail time? A fine?
    What goes on your record?
    What do you do to minimize the damage?

    God, I wish I could get a tacked thread on this...

    If you don't blow or do the FST, you will spend 1 night in jail (well, unless you go in late Saturday or on a holiday weekend and no one bails you out immediately...), you will be charged with misdemeanor DWI (if it's your 1st), you will blow $2-10k (depending on the quality of your lawyer), and you will more than likely get off with nothing on your record after yout trial in a few months - though if your lawyer is good and you gave them no evidence, they might be able to get it dropped.

    If you don't give them evidence, they can't convict you of anything. No jury will vote guilty if the ONLY thing to go on is some cop saying he "detected the presence of alcohol."

    If you drink and drive & get pulled over you WILL spend a night in jail and lose a few thou on legal bills. Whether you also lose your license, do more jail time, community service, etc, depends on whether you were dumb enough to listen to the cop and blow or do the FTS...

    As I've said before, don't drink & drive and then none of this matters...
