but see..i despise this standard. because we can't hold anyone accountable that way. it's the "everyone's doing it" defense that our parents could see right through. "well you think it was bad i did x?? guess what, little timmy down the street did y!!! see...so i'm not so bad."

Maybe I overstated the Clinton angle a bit (Before I posted that, I just read the Astros box from last night and was in a hatin mode ;))

... you have to love Berger's conclusion in light of this breaking news story.

Testimony of Berger before the Commission:

Cohen, not really sure why it matters, but:

    Notes - pants

    documents - portfolio/briefcase

Do you honestly think he's sticking 8x10 reports in his boxer shorts?

I've heard lawyers present their briefs in court.

Berger and his lawyer said that he put the documents in a leather portfolio.

The FBI said that they believed that he put the documents in his clothing.

The FBI said that national archive employees said they saw him put documents in his clothing.

Regardless, what difference does it make?

If he did something criminal then send him to jail, but I see nothing sinister here -- again, a non-issue.

Would he be sharing a cell next to Paul O'Neill?

Hell yeah, if Condi Rice becomes a former administration official in a few months, she can stuff the Presidents Daily Brief down her pants for all I care.

if it had been condi that did this ...

It all depends on what follow through the GWB Admin has on the Berger allegations, if any. If Berger is just verbally reprimanded from the GWB bully pulpit, Condi and Berger would suffer about the same fate, a week or so of bad press. If Berger is prosecuted to the full extent of the law (and the publicity), Condi in comparison would have a walk in the park.

I doubt, that in election 2008 if Kerry is going for reelection, anybody is going to give a damn whether or not Condi took her notes home or not unless she is running against him.

Clinton Aide Investigated on Terror Memos

WASHINGTON (AP) - Sandy Berger, former President Clinton's national security adviser, is under criminal investigation by the Justice Department after highly classified terrorism documents disappeared while he was reviewing what should be turned over to the Sept. 11 commission.

Another stroll down GWB's moral high road ...
