I think there is something to this and if you listen to Sen. Brownback and a few others they've gone beyond questioning Alito to making arguments for overturning Roe by arguing against the principle of stari desisis (sp). Alito's response though has been guarded and very qualified so I don't think its guarenteed that he would. From these hearings I don't get a good feeling either way if he would vote to overturn Roe or not. Brownback pressing him on the issue IMO is more focussed on shoring up opinion among social conservatives.
i dont really understand this as well. my understanding is that CAP was anti-minority and he was a part of it? is that it? is there more? also from my standpoint specter is as good of a chairman as one would get. that idiot that runs the house judiciary makes specter look like wellstone. so i really didn't understand kennedy's lil diatribe.
schumer is coming off as a douche. which he does often. alito is killing him. and me being a liberal who isn't necessarily decided about abortion either way...that says a lot. to make one statement about abortion seem as against anti abortion even in a case of a father committing rape...is ridiculous.

Clinton was impeached. He wasn't convicted in the Senate, but he was definitely impeached. Alito's wife crying was a huge blow to the liberals. It pretty much cast Kennedy/Schumer/Feingold as partisan jerks. Making women cry doesn't really play well in Middle America. Or anywhere in America. Good work libs!
I can relate. I found law school pretty boring at least compared with many liberal arts subjects. Once I decided to finish, no matter how boring, it became more bearable. Socially I found it sort of fun. Of course I was in my 30's and it beat a lot of the jobs I had done. I actually find the hearings sort of interesting. I give so little thought to constitutional law. Despite that, I subsribe to the theory of legal realism that what is consitutional is whatever the current S.Ct,. says it is. So much for the precedents and attempts to claim an open mind. Only a moron could reach his age with no opinions on any important issues that might come before the court. The only hope to stop this lifelong conservative, who is essentially perjuring himself, is a filibuster, which I don't think the Demos have the balls to do. Long after Bush and Delay are gone and disgraced this ******* will still be screwing with our rights and continuing to be a good little house serveant for the powerful at the expense of the rest of us. I have reached the point where I hope Alito and gang do away with Roe. Let the GOP judges defy the will of the great majority who support it. This might even put an end to the bs that they are "strict constructionists" ,followers of precedent, or whatever bs they try to make people believe.

Funny, I was just thinking about this today. I almost hope that they do it and make abortion illegal. It would cause a massive backlash, mobilizing the left and middle-left in a way that nothing else could. There would be a huge nationwide revolt against social conservatives.
That's what I mean about it being a strawman. They give lip service to getting rid of R V. W but it will never happen. It's a wedge issue to rile the RR and keep people like giddy in line. But they know if they ever really overturned it, there would be a backlash like you've never seen. 70% of Americans don’t' want to see R V. W overturned. It would be political suicide.
