Is Ted Cruz eligible to be president...

    So this is coming up now finally.

    It's outstanding to see it happen to the ultimate tea party candidate after they made the claims against Obama.

    However, Cruz is an interested test case honestly.

    Basic facts:
    Cruz was born in Canada to an American citizen woman and a Canadian citizen father.
    The constitution limits the presidency to natural born citizens, a term that is clearly vague.
    The naturalization act of 1790 explains that someone is natural born if they are born abroad to an American citizen and this act is what Cruz keeps referencing.

    However, here is why his case is interesting; the naturalization act specifically denies naturalized citizenship to those born to a father who was not a resident of the United States if they are born abroad.

    Additionally, when the Obama birther argument was raging, constitutional scholars made the argument that if he had truly been born in Kenya (which he wasn't) that he in fact would not be a natural citizen as he would be born abroad without both parents being citizens.

    So is Ted Cruz eligible for the presidency? Democratic lawmakers have already pledged to challenge him in court if he gets elected.

    Bringing up Obama is ridiculous. The Obama birth issue was based on skepticism.

    Cruz is pretty cut and dry. The constitution was not trying to convolute an issue for the sake of making it difficult. Its pretty straight forward; No foreign nationals are to be elected.

    He was born in Canada with no rights birth ties to Canada except for physically being birthed in Canada.
    His father was Cuban, but Cruz was not born in Cuba. This makes his father being Cuban completely irrelevant.
    His mother is a US citizen on a Canadian work visa. This makes him a natural American citizen.

    So what exactly is the problem?

    Obama birthers at least had skepticism on their side until he release his birth certificate.

    The problem is that the conspiracy was that Obama was actually born abroad to a Kenyan father and a US mother, and thus not eligible to be president because a US citizen born abroad is not a "natural-born" one. In other words, what birthers claimed made Obama ineligible is Ted Cruz' actual confirmed reality.

    It's a dumb issue in both cases, but anyone who argued that Obama was ineligible would have to argue the Cruz is ineligible.

    From what I recall and being around several people who were really into the Obama birther movement (unlike the hyped up Starbucks and Trump love affair), it ranged from Obama not revealing his birth certificate, to him faking parts of his birth certificate, to Hawaii wasnt an actual state at the time of his birth, to him being born in Kenya. Him being born in Kenya was the least popular narrative.

    But either way, yes, they are both ignorant issues at this point. Especially considering Cruz has a very slim chance of getting past trump as this time

    It was a fraudulent skepticism enforced with a stipulation never placed upon any other candidate in history, for the sole purpose of drawing a negative association to his race. I'm just as frustrated at the Cruz speculation reinforcing the retaliatory, childish scorecards of modern politics; but don't fail to recognize the birther nonsense for the uninformed, tortured bigotry that it clearly was.

    You can thank social media for this type of behavior. Its here to stay. Obama might be the first hit hard by it, but he wont be the last.

    Right- but the theory was that he was hiding or faking his birth certificate because he was born outside the US. But no one really claimed that his mom wasn't his mom. The argument centered on the idea that he secretly wasn't born on US soil - which is actually the case for Cruz.
