    Sounds like the Courts have revealed their hand:

    TRUMP: “Big problems and discrepancies with Mail In Ballots all over the USA,” Trump wrote, without offering evidence for his assertion. “Must have final total on November 3rd.”

    KAVANAUGH: “Those States want to avoid the chaos and suspicions of impropriety that can ensue if thousands of absentee ballots flow in after election day and potentially flip the results of an election,” Kavanaugh wrote in a concurring opinion released Monday night. “And those States also want to be able to definitively announce the results of the election on election night, or as soon as possible thereafter.”

    It sounds like Trump will go to court to challenge any ballot in the US that not only arrived past Nov 3rd is not legitimate, but any ballot that is NOT COUNTED on Nov 3rd is not legitimate.


    If the courts interfere with the counting of ballots in a way to hand Republicans a victory, there will be civil war.

    That's his payback for that whole Justice Kennedy stepping down only if Trump nominates Kavanaugh because Kennedy's son gave loans to Trump when no one would lend him money. The circle of bribery.

    Or that could backfire as the later cast mail in votes might be from more rural counties, and Trumps antics caused Dem voters to freak out and cast in early while those Rural Trump voters believe the postmaster general is a stand up patriot who will work tirelessly to count every Trump vote.

    Keep in mind that mail in voting has almost always been overwhelmingly a Republican asset. I do think this is an obvious election rigging attempt but possibly a terribly executed one that could blow up in their faces.

    Yup he basically endorsed Trump's wacky conspiracy theories about counting votes after election day and he specifically referenced the right of federal courts to overrule state courts on election administration.

    Biden better win big and the Democrats better win the Senate. Then its time to blow up the filibuster and work on leveling the playing field and reforming the government to prevent a future president from running roughshod the way Trump did.

    The thing is, Trump has already assured his demise. People are not waiting to vote. They are sending them in early or voting in-person early.

    Most states aren’t even allowed to start preparing the mailed in ballots for counting until Election Day. The Republicans and their loyal Supreme Court justices would like to stop the counting of ballots as soon as Trump has a lead anywhere from in person voting under the pretense that you have to know who won on Election Day, which is BS.

    I guess the question I have is what evidence do we have that Trump voters are all waiting till Election Day to vote in person in a way that overwhelms the vote today on election night in a way that makes delayed mail in votes the key to a Dem win?

    To me, I’ve seen the Dem base either vote early in person, or vote by mail/drop off a week ago to ensure their vote is there at the ballot box well before election night so it’s counted that night. I don’t know of one single Dem base voter who is waiting till election night to then... that night send out their vote in the mail.

    So I personally think these tactics will maybe end up biting Republicans in states like Texas with rural mail in voters in the ass.

    Will anyone be shocked at all if on election night it’s clear as day that Biden is the winner and Trump starts crying like a baby about how he can’t concede because there are MILLIONS of Republican votes that were mailed in that still need to be counted?

    FYI I do believe the election will mostly be decided on Election Day in person though but we as Americans will be relying on the least politically in touch voters to make their decision at the last minute even though most of those voters have probably already made up their mind. If even a small percentage of those voters vote Biden...which again is usually how elections are decided... it’s game over. Trump needs every single one of those voters and some.

    In order for Trump to win he needs:

    -All independent “low information” same day voters to vote for him
    -Massive turnout from his base with millions of new registered voters to show up
    -Mail in votes THAT WERE SENT EARLY to NOT be counted through some issue with the mail or other scams.

    I just don’t really see Dems voting late enough by mail for this to really be an issue that decides the election.

    Most Republicans will turn out on election day and vote as they don't fear the virus. Dems are voting early and by mail. This will mean the Republicans will close the gap rapidly on Nov 3 and could take an early lead that lasts until midnight. If they stop counting absentee ballots at midnight, that could mean Trump wins the midwestern states.

    Which votes are counted first? Are in-person votes made on election day counted before the mail-in votes that came before election day?

    They will not stop counting ballots received by Election Day. People voting on Election Day will also have their votes counted.

    Wyoming, wisconsis, West Virgina, Pennsylvania, Mississippi, Alabama.

    6 states that do not begin preparation until election day. 4 of those states are red states.

    How does 6 states represent "most states"?

    I would vote this thread as the most misinformed thread of this election.

    Yes, his arguments sound very similar to Trump's (over Twitter lol). It's not a good look for a SCJ.

    The thing that is crazy is don't state certify their election result a few days to weeks later (as late as December), so that they, I assume, finish counting and verifying everything. Usually the outcome is known on election night by the *media* (lol) calling their projection. But we know 2020 has a chance of not calling it due to delayed counting in several key states (massive ballots counting). It's too bad that the GOP also blocked PA from starting counting early (funny how they are arguing both sides: can't count now and don't count anything received after election day).

    What is the SCOTUS rules that ballots received after election day don't count?

    Civil War, or just some hardcore nutjobs to start taking out Supreme court justices - if they screw with the democracy, you never know what some nutjob people are capable of doing to protect it.

    I don't think it will matter. I might be wrong, but I think Biden will with a big enough lead that TRUMP will try to get ballots that arrive after the Election to count.

    Our country is the laughing stock of the democratic world. Each f'in state has their own rules that they can f with. Just another way of voter suppression.

    You're right, I had the states that wait until election day to count absentee ballots (a majority) in my head when I wrote that and messed up.

    Doesn't change the fact that Kavanaugh is already invoking the ghost of Bush V. Gore to have the federal government flex on the states to stop ballot counting.
