    Well the good news, is that now that marriage discrimination has ended, they won't be doing that. They'll just be sticking with the incentives for marriage in general.

    Well put and one reason why I felt that gay marriage would be the law of the land. Both for equal protection but also because of full faith and credit. Once one state recognized gay marriage it was inevitable that all states would have to.

    Regarding Scalia's dissent. I would have much more respect for Scalia if he didn't show a willingness to betray his own legal principles. In Bush v. Gore he agreed with the majority opinion that undermined state constitutional rights to decide their own rules for elections. He complains about the court overstepping it's bounds over elected legislatures and also being run by a patrician elite yet had no problem with doing the exact same thing in Citizen United.

    Scalia is a very sharp legal mind but it should be clear that he is an ideologue first and foremost who is willing to allow ideology to shape his decisions when it suits him.

    Marriage was always supposed to be an institution between a male and a female.

    Or maybe this ruling will stunt population growth?

    If I still lived in Texas I would be upset about how the AG is wasting taxpayer money on something that will be shot down.

    I mean who is going to rule that he is wrong? If he blatantly disputes the Supreme Court...

    We are going to go down this road? We are going to have some judges issuing them in defiance and some not issuing them (also in defiance lol)? People suing the state of Texas to get it enforced? What would they do if he still refuses since he doesn't respect the SC's authority?

    At some point someone would have to slap him right?

    I imagine he'll back off.

    Homosexuals make up maybe 5-15% of the population so even if they can marry that will have little impact on population growth. For that matter many homosexual couples still choose to have children through surrogacy, invitro fertilization or other means.

    I am sure the next step will be lawsuits against churches for refusing to marry same sex couples.

    I'm sure he will back off. Paxton is a lawyer who presumably passed 1st year constitutional law. He knows that this won't hold but is most likely doing it for pure politics.

    which, again is somewhat irrelevant to the main point of this ruling and was addressed in both the oral arguments and the ruling itself.

    People could but they will probably lose. Churches were and still can continue to decide who they want to marry. This ruling doesn't change this anymore than if Roman Catholic Church refused to marry a Hindu couple.

    I know the only reason I had kids was because I couldn't legally marry a man in every state. If only this ruling had been 10 years ago!
