Just received my first child support wage garnishment letter for one of my employees. He owes back child support and now the county wants to withhold 50% of his weekly salary for current child support plus an additional 15% for the arrears.

This can't be right, how the hell can he live on only 33% of his pay? He basically has no money to see his kid at all. I feel terrible for the guy. Regardless whether he's a good father or not, you can't take 66% of a guy's wages and expect him to be able to survive. He's just going to miss more child support, and have his arrears go even higher. Who the hell comes up with stupid laws like this?

You should probably pay him more.

Pay the guy off the books, not as an employee. In cash ($$)

not sympathizing with him nor making judgments about him as a father, I just don't see the wisdom in taking 66% of a person's wages. There is no way he can keep up with his payments and have things like electricity.

It's hard enough to make ends meet with two incomes and one rent/utilities.

Now imagine two rents, two utilities, etc. with the same two incomes.

Everyone loses financially anyways when parents split up.

    You are correct.
How long has it been since you hired him.
Guys in his situation generally end up leaving their jobs once the Gubment catches up with them

I don't see the wisdom in the amount either, but for it to get that high how long has he had to dodge them? At what point is it him being a bad father and not a stupid law?

The cap in Texas is actually 50% of disposable income. The cap in New York is 65%, which is the highest possible under the CCPA (Consumer Credit Protection Act).

The employee can seek a reduction from the court but he's probably not going to get it.

The reason they are taking the money is because he hasnt been paying his child support...
No doubt it is hard for him now, but how hard has it been for his kid up until now?
maybe he can move back in with his parents? But why should he get a life by denying his kid one?

I guess it would have been better to kid the mother in the stomach at the opportune time?

No one cares about a 'collection of cells'

The reality is he did not get an OPT OUT option that mothers get.

I wish wage garnishment would be a standard and easily provided remedy to any and all debts. Don't create liabilities that you can't afford and then cry about having to pay them.

I'm sure he's like Rocket River and wish he had punched his baby mama in the gut while she was pregnant, but he didn't.

If he took care of his responsibility and voluntarily paid his child support as agreed there would be no need for garnishment and additional withholding to eliminate the arrears.

I hope you don't have kids because you seem to care about your money more than the well being of children.

Kids come first. I'll live in a tent and eat ramen noodles to ensure my kids are taken care of.
