I think you misunderstood me. If you have a client on trial for either of those two...which are you going to push VERY HARD for? Would certain evidence make the more unfavorable , harsher, of the two more likely? Yes it would.
I can't label this a hate crime yet. The shooter likely did have some form of prejudice to commit such a heinous and callous act of shooting three similar people execution style, but from the information out there, it'd be hard to prove he did it solely as a hate crime. Seems to be a long-standing dispute with neighbors. Regardless of hate crime label or not, the guy is going to go away for a long time, if not have the death penalty. I support the death penalty for slam dunk cases like this. He confessed. No need to burden the public to extend his meaningless life when he is unfit to live in society.

If I was having to defend him I'd have to come up with something that could make this anything but murder and honestly I have no clue what that could be. It being labeled a "hate crime" or not getting that label makes absolutely no difference when the man is facing the death penalty or life imprisonment one way or the other. I just can't think of any case he'd have though.
No. But we're talking about three particular people and hate crimes of darker skinned people in this country is nothing new.

Wow 5 hours for wisdom teeth? Were they using a xacto knife? I only had one wisdom tooth and that was like some sort of medieval procedure. Horrible pain during the recovery.
The dentist took care of everything else during the same surgery (replaced some fillings, etc.). That might have taken as much or more time compared to the wisdom teeth, I'm not sure.
Simplest explanation is usually the right one. People commonly get assaulted/murdered over territorial/material disputes, even pithy ones like this. What a damn shame. RIP.
Hate crimes are notoriously hard to prove as the state has to prove that the suspect's motive stemmed from racial, religious, etc. bias toward the victim(s). In a similar vein, I think that the death penalty will be off the table here because the state has to prove that he intended to deliberately kill all three victims. Now if he did kill them all "execution style", then that strikes me as a clearcut case of premeditated intent but once it goes to lawyers, all bets are off. As for the "narrative" you speak of, where have you been? This has been going on since George Bush screwed the pooch with Iraq. The Jhadists have been using our American arrogance and religious intolerance toward Islam against us to further their cause now for over a decade. In fact, one of the most interesting aspects about the new conservative darling "American Sniper" is how Clint Eastwood chose to deliberately downplay Kile's absolute disdain, bigotry and animosity toward the very people he and we were over there to win over. This clearly illustrates the disconnect that exists between what our political objectives are in the fight against radical Islam and what the people we send over to realize those objectives project to the populace caught in the middle. We end up feeding that narrative no matter what our intentions were originally. As the saying goes: "The road to hell is paved with good intentions."
My feelings exactly. That smells like a cover story to me to keep the lid on as this has the potential to blow up into a full scale mess if the jhadists get involved. The more I read about Hicks I'm inclined to believe that he didn't specifically kill them because they were Muslim. It sounds like he was a volatile guy who had running disputes with almost all of his neighbors. While he might've harbored hatred towards Muslims and religious people in general it sounds like he was already a ticking time bomb and could be set off for a variety of reasons.

I'm curious about what exactly qualifies this as "execution style" it sounds like he broke into their house and shot them in the head. While that is horrible I'm not sure whether that shows and particular expertise or extensive planning. Just to be clear I'm not saying this is a crime of passion as there was some planning but my feeling is he was angry at many of his neighbors and likely had thought about killing them already.

I've always thought "execution style" meant someone was shot in the back of the head while on their knees, but why would 3 people get into that position?
