Because what you are asking is irrelevant. The 911 caller said he was holding the BB gun and pointing it at people and children. He wasn't.

Besides, the was only on his shoulder for a short period of time. It was mostly pointed down, including when the cops rushed in.

It is relevant if it justifies someone calling 911 or not. It justifies it. Unlike a toy gun with a red muzzle, that gun looks real and is a real gun. You can't demonize a guy for calling 911, the failing was the Rambo police who stormed in with rifles acting like they were taking an airport in Iraq.

The caller didn't have a security camera view.

He leveled it chest high and pointed at the shelf. He leveled it knee high when the caller said he was loading it. Loading a gun is a perfectly reasonable assumption for that action BTW.

Can the caller be prosecuted for his role in this disaster?

And as stupid and senseless as this was, why is the guy walking around a Walmart holding a real looking weapon? Was he planning on buying it? If freaking children used to get shot by police back in the 80s and early 90s when actual toy guns looked real, I'm not surprised a full grown man carrying a non-toy gun could be seen as a threat. Add the paranoia around mass shootings that exist today and it's a recipe for disaster.

I've mentioned this before, but there was a similar incident at my place of work immediately after the VA Tech massacre. Some idiot old white guy decided to show his buddy up on the top floor a replica assault rifle that was used for demo purposes and went strolling with it through the building. Some ladies saw him walk by their office and called the police. The entire building was evacuated and the SWAT team went in. The guy just evacuated with everyone else, completely clueless that he was the reason for it. Can't believe he wasn't fired for such poor judgement.

I would not begrudge anyone for calling the police when they see someone casually walking around a public place with what they perceive to be a real gun. Unfortunately, in this case it sounds like this dude was either purposefully embellishing or was just too wound up/paranoid.

The police response is a whole other story.

This is a very realistic looking gun . Are these not packaged into some kind of container/box ?

If Walmart security didn't make the call there is no way they should have come in guns blazing.

Apparently it was lying outside of the box. Which, is still strange if he was planning on buying it. Wouldn't he want the box and everything that came with it. Or did he just absent-mindedly grab the "gun" to pass some time as he was talking on his cellphone?

Huh? I don't really see how that is relevant. If a civilian/bystander calls don't take it very seriously?

Hard to tell . He is off camera at some points and also there could be customers out of the camera eye .

The cops definitely seem to shoot without trying to even confront the guy . They should be thrown off the force at the very least , however this guys actions deserve a Darwin award .. aimlessly walking around a wally world with a very realistic looking gun just seems like an extremely stupid thing to do .

What I don't understand is why didn't they just stop at a safe distance and then use a loud speaker or something to tell the guy to put the gun down. Kinda like a hostage situation. Instead they're basically going in with guns drawn, bum rushing him, and ready to shoot.

From the video, it looked like there was very little time when they engaged the dude and then started shooting.

Considering it wasn't even a real gun and with how fast they rushed him, I highly doubt they asked. If they did, Crawford was probably like wtf is going on since he wasn't even doing anything. The video kinda shows that.

So . . .. getting shot by cops while black is not homicide
    if you are black BUT
    If you are white
and frightened to death by cops killing a black man
then that is truly homicie . . .

So . . . .who is charged with this .. . the black man for being shot
    or the cops
    or the caller. . . . . ..
