[NYDNews]Law suit claims Rockets players harassed gay man

Feb 2013--Dwight was not with the Rockets yet.

 

Problem with this lawsuit--he could not identify who said what to whom. He had his back turned to the guys. How could he sue the whole team?

Also does his catering company only do NBA games? He couldn't get overtime working on some other gigs? He must have raised a huge fuss about it that his company didn't assign anymore to any NBA games.

Sounds to me like this guy is trying to play the litigation game, and lost this round.

I would become gay too, if I could sue any athlete who passes me on the sidewalk and win.

The ruling has nothing to do with whether any Rocket players said what the plaintiff alleged they said. The dismissal, as reported, is based on the fact that even if some Rockets players did say what was alleged, the law does not provide for a claim against the Rockets.

The plaintiff is suing for employment discrimination and the law provides for such claims against one's employer-- which the Rockets are not-- and not generally against other persons or entities. The plaintiffs lawyer was likely trying to draw as many defendants into the suit as possible at least to start with and probably asserted some tenuous connection between the Rockets and his actual employer which the court rejected.
