Using his Bird Rights. If they wanted to use cap space, they would either need to renounce his rights or sign him at a pay cut. Their plan, we know now, is to operate above the cap which has severely limited the free agents they can sign, but allows them to pay Lebron, Bosh and Wade up to the max.
Because a HUGE part of the Bosh appeal to me is that he can be had while keeping Parsons. It seems to me that he will not make a move until Lebron decides -- who knows if that will happen before we have to match the douche offer Cuban is preparing to make to CP / can move Lin?
Because this implies that the Heat are not planning on having any cap space as using the full MLE implies they will never go below the cap. Since Miami holds Bosh's bird rights they can offer him his full max by going over the cap.
I'm at work so correct me if I'm wrong, but the Mavs don't have space under their cap to offera max. My guess is that Cuban hates us with all his soulless heart and will give Parsons the most he can, knowing we will match. But whatever that number is, its still not the max. Take some solace in that at least. My guess is 12M.
Max for Parsons would be right about 14.5M iirc. Doable, but you are right it would take up cap space while they wait for an answer from Parsons.

They could've still signed him that's the whole point. You get your MLE to sign a player even if you are over the cap.
That is not true. If Bosh walks, then the Heat would go under the cap (even if they resign LeBron and Wade), and would no longer be able to use the MLE. So, the fact that they are offering means they will be re-signing all three of Bosh, Wade and LeBron. The only thing that remains to be seen is if the Bosh re-signing is a sign and trade to Houston or not -- but, all indications are that Bosh would prefer to stay in Miami if LeBron and Wade are, plus, I don't see how it is in the best interest of the Heat to do a sign and trade of Bosh if LeBron and Wade are returning, when, if they kept that cap space (and thus did not have the MLE) they could make a run at a free agent (be that Deng, Anthony, Gasol, etc).

With Miami operating over the cap, they have no reason not to offer 4 year max to Bosh, unless they can get him to agree to take a little less per year to get a 5 year deal. They can still get the discount they need from Wade on a 4 year deal to get under the luxury tax and repeater tax threshold. So it all comes down to whether LeBron wants to stay or go.
